Description:
Provision of parcel transport services by road transport to the Netherlands for RD Warszawa

The subject of the contract is the provision of automotive line courses in international traffic - i.e. AM services, which consist of transporting by road transport Consignments, the contents of which will be postage, whereby the Contractor is obliged to accept Shipments to carriage at the place and date specified in the Schedule for the implementation of the AM Service, annex 1 to the contract, and the issuance of Consignments accepted for carriage at the place specified in that Annex.

1. The subject of the contract is the provision of linear car services in international traffic - i.e. the AM Service, consisting in transporting Shipments by road, the contents of which will be Postal Shipments, under which the Contractor is obliged to accept Shipments for carriage at the place and time specified in the Schedule for the implementation of the AM Service, constituting Annex 1 to the Contract, and issue Shipments accepted for carriage in the place specified in this Annex.

2. The volume of rates for the basic order to be executed by the Contractor is presented in the table below.

2.1.Course name / relation: Warsaw – Amsterdam (Netherlands);

2.2.Vehicle category: category Ib up to 3,5 tonnes

2.2.1.Volume for the basic (main) order:

2.3.Maximum number of courses (with the right of option) - 34;

2.4The number of courses covered by the so-called right of option (30%) - 10;

2.5.Number of courses covered by the so-called basic order (70%) - 24

3. A detailed description of the implementation of the AM Service is described in the "Schedule for the implementation of the AM Service" constituting Appendix No. 1 to the model contract.

4. All cars intended by the Contractor for the implementation of the subject of the contract should meet the requirements in accordance with Appendix No. 2 to the model contract.

5. Based on its experience, the Ordering Party estimates that for the proper implementation of the AM Service it is necessary to have a minimum number of cars:

5.1. Course name/relationship: Warsaw – Amsterdam (Netherlands)

5.2. Estimated number of vehicles necessary to provide the AM service in the period:

5.2.1.December - January: 2

5.2.2.February - June:1

6. Detailed rules for the implementation of the subject of the contract are specified in the draft contract constituting Annexes No. 3 to SWZ.

7. The Contracting Authority does not provide for convening a meeting of Contractors.

8. Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority shall not require the Contractor, subcontractor or further subcontractor to employ persons performing activities in the scope of the contract performance on the basis of an employment relationship, within the meaning of the Act of 26.06.1974 - Labour Code (Journal of Laws of 2020, item 1320).

9. The Contractor may entrust the execution of part of the contract to the subcontractor, and cannot entrust the subcontractor to perform the contract in full.

10. The Contracting Authority provides for the possibility of awarding services to the existing Contractor, under the direct contract procedure pursuant to Article 388(2)(c) of the PPL Act, a contract consisting in the repetition of similar services, in accordance with the subject of the basic contract (up to 50% of the value of the services being the subject of the basic contract).

Conditions under which the aforementioned contract will be awarded with free hand:

The subject of the additional order is the provision of the AM Service, consisting in transporting shipments by road, the contents of which will be Postal Shipments, under which the Contractor is obliged to accept Shipments for carriage at the place and time specified in the Schedule for the IMPLEMENTATION of the AM Service, constituting Annex 1 to the contract, and issue Shipments accepted for carriage in the place specified in this annex.

1) The volume of exchange rates for an additional order to be executed by the Contractor is presented in the table below.

1.2) Course name/relationship: Warsaw – Amsterdam (Netherlands)

1.3) Vehicle category: category Ib up to 3.5 tonnes

1.4) Volume for additional (supplementary) order:

1.4.1.Maximum number of odds (with option law) - 17

1.4.1.1.Number of courses covered by the so-called option right (30%) - 5

1.4.2.1.Number of courses covered by the so-called basic order (70%) - 12

2) The draft agreement will be forwarded to the Contractor together with the invitation to negotiate.

3) Contractual penalties will be provided for in the same cases as in the contract concluded in the procedure for the basic order.

4) The obligations of the Contractor and the Contracting Authority shall be governed on a basis analogous to the contract concluded in the procedure for the basic contract.

5) Order period: up to a maximum of 4 months from the date of signing the contract.
