3.1. The subject of the contract is a comprehensive supply of electricity including the sale of electricity and the provision of electricity distribution services divided into 2 parts for the period from 01.01.2024 at 00.00 to 31.12.2024 at 24.00 for the needs of Krakowski Park Technologiczny sp. z o.o.

3.2. A detailed description and manner of performance of the contract are included in the Description of the subject of the contract, constituting Annex 3 to the SWZ and the draft provisions of the contract constituting the Annex

No. 10 to SWZ.

A detailed description of the subject of the contract is attached as Annex 3 to the SWZ. Numbering in accordance with the Annex: 1. The subject of the contract is a comprehensive supply (including the supply and provision of distribution services) of electricity to 1 point – office building "KPT Podole" in Krakow at Podole 60 (PPE) with a total estimated volume of 1 600 000 kWh in the period from 01.01.2024 at 00.00 to 31.12.2024 at 24.00. It is planned to install micro-installations in the Ordering Party's building during 2023. The microinstallation will be connected to the DSO network. The Contractor will absolutely, throughout the duration of the Agreement, be obliged to settle the amount of electricity introduced into the DSO network against the amount of electricity taken from this network for its own consumption by the Prosumer generating electricity in a micro-installation. The Contracting Authority is obliged to inform the Contractor about changes affecting the manner of conducting settlements, in particular about the loss of the status of the Contracting Entity, changes in the total installed capacity in the micro-installation, type of energy source in the micro-installation, permanent disconnection of micro-installations from the DSO network, within 14 days from the date of the change.

2. The sale and provision of electricity distribution services is to take place under the conditions specified in the provisions of the Act of 10.04.1997. Energy Law (Journal of Laws 2022.1385 i.e. of 2022.07.01), in accordance with the applicable regulations to the above-mentioned Act and the provisions of the Act of 23.04.1964 Civil Code.

3. The planned electricity consumption during the term of the contract (12 months) is 1 600 000 kWh. The planned consumption of electricity is only indicative, used to compare offers and in no case constitutes an obligation on the part of the Ordering Party to purchase electricity in the given quantity. The Contractor shall not be entitled to any claim for failure to collect by the Ordering Party an indicative amount of energy.

4. Place of electricity supply: Current terminals of the rail connector from the side of Tauron Dystrybucja sp. z o.o. devices in the transformer station assigned to the PPE code 590322429302771282 and 590322429302771299 located in Krakow at Podole 60 Street. The place of demarcation of equipment ownership between the energy company dealing in the distribution of electricity and the Ordering Party are the current terminals of the rail connector from the side of the devices of Tauron Dystrybucja sp. z o.o.

5. The place of electricity measurement is the place of installation of current measuring transformers. Measurement of supplied electricity is carried out through a metering and settlement system,

whereby:

Connection 1:

(a) The 30/5A current translators are the property of the Ordering Party,

(b) Voltage translators 15000:1 ,73/ 100:1 ,733 V are the property of the Ordering Party,

c) A 1-tariff counter of active energy with a max power and reactive energy indicator is the property of the Ordering Party and is built: in a transformer station,

d) The 1-tariff active power control counter with max power indicator is the property of the Ordering Party and is built: in the transformer station.

Connection 2:

(a) The 30/5A current translators are the property of the Ordering Party,

(b) Voltage translators 15000:1 ,73/ 100:1 ,733 V are the property of the Ordering Party,

(c) 1-tariff counter of active energy with max power and reactive energy indicator, which is the property of the Contracting Authority,

d) The 1-tariff active power control counter with max power indicator, which is the property of the Ordering Party, and are built up: in the transformer station.

6. The contracting authority qualifies for connection group III. The connection power for each connection is determined Pp = 800 kW, the contractual power Pu = 620 kW and 156 kW, tg = 0.4, the minimum contractual power for each connection, P umin = 620 kW and 156 kW.

The microinstallation was connected to the DSO network after 31.03.2022. The place of demarcation of equipment ownership between the power company dealing with the distribution of electricity and the Ordering Party are the current terminals of the rail connector from the side of the devices of Tauron Dystrybucja sp. z o.o. in the transformer station No. 22464.

5. The place of electricity measurement is the place of installation of current measuring transformers. The measurement of the supplied electricity is carried out by means of a metering and settlement system, whereby:

Connection:

(a) 20/5A current translators are the property of the Ordering Party,

b) 15/V3/0,1/V3 kV voltage translators are the property of the Ordering Party,

(c) 1-tariff counter of active energy with max power and reactive energy indicator, which is the property of the Contracting Authority,

d) Active Power Control Counter 1-tariff with max power indicator, which is the property of the Contracting Authority,

and are built: in a transformer station.

6. The contracting authority qualifies for connection group III. Connection power for the entire facility Pp = 500 kW. The following are set for the connection: Connection power Pp = 500 kW, conventional power Pu = 450 kW, tglo= 0,4, minimum contractual power resulting from 20% of the rated current of current transformers at cosl = 1, P umin = 104 kW.

7. Settlements for the electricity sold will be based on monthly indications of the metering and settlement system according to the B21 tariff group.

8. At present, the Ordering Party has concluded on 30.08.2022 an electricity sales agreement with GREEN S.A. with its registered office in Warsaw, Naruszewicza 27 lok. 2, 02-627 Warsaw. The contract is concluded for a definite period until 31.12.2023 at 24:00.
