This order has been divided into the following 3 parts:
Part 1 - Successive delivery of bread and confectionery products to the warehouse in Nowa Dęba;
Part 2 - Successive delivery of bread and confectionery products to the warehouse in Kielce;
Part 3 - Successive delivery of bread and confectionery products to the warehouse in Sandomierz.
Contractors jointly applying for the award of the contract (Consortium / partners of a civil law partnership) within the meaning of Article 58 of the PPL:
(1) are jointly and severally liable for non-performance or improper performance of the contract;
(2) they must appoint a representative to represent them in the procurement procedure or to represent them in the procedure and conclude the contract relating to this contract.
Successive delivery of bread and confectionery products to the warehouse in Nowa DębaThe subject of the contract is the successive delivery of bread and confectionery products to the warehouse of the 33rd Military Economic Branch located in Nowa Dęba, 1 Anieli Krzywoń Street.
The production of the subject of the contract, the method of its packaging and transport must meet the requirements of the applicable national and EU food law. These provisions are set out in the Annex to the SWZ – draft agreement.
Contractors as entities operating on the food market, running food trading or catering establishments are obliged to ensure food safety in accordance with the principles of the Hazard Analysis and Critical Control Points System, called the "HACCP system" (procedure aimed at ensuring food safety by identifying and assessing hazards from the point of view of food health requirements and the risk of hazards occurring during all stages of production and marketing food, this system also aims to identify methods to eliminate or reduce hazards and to determine corrective actions). Therefore, the Contractor applying for the award of the contract must have the following up-to-date documents (including for the duration of the contract), which it shall present at the request of the Contracting Authority:
a) confirmation of the implemented HACCP system in the form of a HACCP certificate issued by companies with accreditations and authorizations of the Polish Centre for Accreditation
based in Warsaw or a national accreditation organization for a given country, or
b) a certificate of the competent authority of the State Sanitary Inspection or the Veterinary Inspection body on the supervision over the use of the implemented HACCP system, confirming the fulfillment of the requirements necessary to ensure hygiene in the production process or trade of the articles being the subject of the contract and to ensure the proper quality of these articles.
The agreement on this public procurement will be in force from the date of its conclusion until 31 December 2024. The parties to the future contract agree that the performance of the contract will start no earlier than January 1, 2024 and will last until December 31, 2024 or until the amount constituting the maximum remuneration due to the Contractor for the performance of the contract is exhausted, in accordance with the content of the offer submitted by the Contractor.
If the Contracting Authority uses the contract executed under the option right, the Contracting Authority shall, by 30 November 2024 at the latest, submit to the Contractor the first written statement regarding the contract awarded under the option right together with its scope.
The delivery of bread being the subject of these proceedings will take place 6 times a week (from Monday to Saturday), while the delivery of confectionery products will take place according to the needs of the Ordering Party up to 6 times a week.
The tender, statements and other documents related to these proceedings, including subjective evidence, shall be submitted by the Contractor as an electronic document or a digital representation of the document with a qualified electronic signature (document in the data formats listed
in the Regulation of the Council of Ministers of 12 April 2012 on the National Interoperability Framework, minimum requirements for public registers and exchange of information in electronic form and minimum requirements for ICT systems - with a qualified electronic signature).
The offer consists of:
1) Offer form – completed and signed with a qualified electronic signature by persons authorized to represent the Contractor, drawn up in accordance with the template attached to the SWZ,
2) Detailed valuation form (pursuant to the part applied for by the Contractor) – completed and signed with a qualified electronic signature by persons authorized to represent the Contractor, prepared in accordance with the template attached to the SWZ.
