The Contracting Authority requires that the data provided by the Contractor, in Annex 2.1. to the SWZ – Offer Form – detailed part, clearly and precisely indicate the subject of the contract. The data provided must allow the Ordering Party to unambiguously identify the subject of the contract in terms of configuration in accordance with the requirements of the Ordering Party using generally available methods (e.g. manufacturer's website) in order to check the correctness of its parameters with the requirements of the SWZ. If the model or name of the subject of the contract provided by the Contractor does not fully reflect the fulfillment of the Ordering Party's requirements, technical data in terms of configuration and accessories of the object should be indicated.
The Contracting Authority allows offering the subject of the contract with parameters exceeding the requirements of the Ordering Party, with modern technological requirements, meeting at least the minimum requirements set out in Annex 1 to the SWZ and not worse in terms of quality and technical conditions, while maintaining its appropriate functionality and purpose.
The Contracting Authority informs that pursuant to Article 101(4) of the PPL, if the description of the subject of the contract contains a reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3), the Contracting Authority shall allow solutions equivalent to those described.
