The subject of the proceedings is "Purchase and delivery of a mechanical device (WUKO) for the maintenance and proper operation of the sanitary sewage system in the Municipality" as part of the investment "Construction and extension of the sanitary sewage system in the Przeciszów Commune – stage VI, part 1, in Piotrowice". A detailed description of the subject of the contract is presented in the SWZ, and in Annex 9 to the SWZ.
1. The Contracting Authority allows the possibility of offering equipment and devices with equivalent or higher technical parameters than those listed in the SWZ. In such a case, pursuant to Article 101(4) of the Act, the Contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to demonstrate that the equipment and devices offered by it meet the requirements specified by the Contracting Authority. The basic form of demonstrating that the equipment is equivalent or has higher parameters is to provide a detailed specification. 2. As part of the offer price, the Contractor will be obliged to deliver the vehicle to the User's registered office – Gminny Zakład Wodociągów i Kanalizacji in Przeciszów, Długa 166, 32-641 Przeciszów, and to conduct training of the User's employees in the field of ongoing service of the subject of the contract. Theoretical and practical training will be carried out at the headquarters of the above-mentioned User, using the vehicle being the subject of delivery, multimedia and traditional materials. The training will concern the operation of the vehicle and the performance of current operational work. The exact date of the training will be determined by the Contracting Authority and the Contractor after signing the contract. The training will be conducted only on working days during the working hours of the User's employees, i.e. 7.00-15.00. The training will be held in Polish. The training will be confirmed in writing by the Contractor and training participants (persons designated in writing by the User) under pain of nullity. 3. The Contracting Authority requires that the offered type of vehicle is not a prototype, i.e. that it is included in the Contractor's sales offer (currently or in the past). To confirm compliance with the above requirements, the Contracting Authority requires a statement to be submitted on the offer form. 4. The subject of the contract also includes all works and obligations of the Contractor, listed in the draft provisions of the contract. 5. The parameters of the subject of the contract presented in Annex 9 to the SWZ constitute the minimum technical and quality expected by the Ordering Party. Any indication of the name of the products and their manufacturers is intended only to approximate requirements that could not be described by sufficiently precise and comprehensible terms.
