1. The subject of the contract in the procedure for the award of a public contract for the purposes of which this document has been drawn up (hereinafter also referred to as the "Procedure") is a service for the management of unsegregated (mixed) municipal waste consisting in:

1) acceptance of unsegregated (mixed) municipal waste from the handling station,

2) transport of unsegregated (mixed) municipal waste from the transhipment station to the municipal installation,

3) landings and development of unsegregated (mixed) municipal waste in a municipal installation

- hereinafter referred to collectively as 'municipal waste management service',

4) the implementation of the services and obligations associated with the services expressed above in paragraphs 1 to 3.

2. Description of the item of the order is made out in Annex 3 to SWZ — Description of the object of the order (hereinafter referred to as “OPZ”).

1. Based on historical data, the basic and optional scope of the contract is established based on the volume of the stream of unsegregated (mixed) municipal waste on which the municipal waste management service will be carried out:

-Tarnowo Podgórne: min. 6600.00Mg, max. 7200.00MG;

- TP-KOM Sp. z o.o.: min. 4000,00Mg, max. 4700.00Mg;

- PUK Bytkowo Sp. z o.o.: min. 600Mg, max. 750.00Mg;

- KOMLUB Sp. z o.o.: min. 1000.00Mg, max. 2000.00Mg.

2. The amount of unsegregated (mixed) municipal waste shall depend on the amount of waste generated in the municipalities indicated in paragraph 1 and collected by the entity providing municipal waste collection services or collected by the entities indicated in paragraph 1. The Ordering Party guarantees that the total size of the waste stream will not be less than 12 200.00 Mg. The basic scope of the order, as defined in the previous sentence, is a guaranteed scope, with the reservation that the minimum limit may also be achieved by exercising the right to extend the basic scope by the option range by one or more Ordering Parties indicated in paragraph 1.

3. The contractor shall be able to ensure the acceptance and treatment of the maximum waste stream size indicated in paragraph 1, i.e. 14 000,00 Mg.

1. Transfer to the Contractor of unsegregated (mixed) municipal waste shall be:

1) in the transshipment station - Transhipment point in Rumianku, gm. Tarnowo Podgórne, remaining at the disposal of TP-KOM sp. z o.o. Tarnowska Komunalna Economy,

2) after a notice to the Contractor, addressed by the Contracting Authority, by e-mail to the address of the Contractor indicated in the contract or by telephone to the Contractor number indicated in the contract, not later than 24 hours relative to the scheduled moment of transmission of the notice, unless the Contractor in clearly indicates another (longer/later) term,

3) on the following days of the week Monday to Friday, from 6.00 to 16.00

2. Under the notice referred to above in paragraph 1 (2), the Contracting Authority shall provide the Contractor with the following information on the estimated amount of waste necessary to collect the proposed date for the implementation of the services.

3. Under the one-time notice, the Contractor shall not be obliged to accept a stream of unsegregated (mixed) municipal waste:

1) less than 70 Mg

2) greater than 500 Mg

4. The volume of unsegregated (mixed) municipal waste to be received by the Contractor from the handling station will be within 100 — 200 Mg of waste.

5. The Contracting Authority shall not send notices to the Contractor at a frequency of more than 10/per month and less than 4/per month.

6. The transfer of waste collected in the handling station shall consist of:

1) to report to the driver of the vehicle to the weight operator;

2. Verification of a vehicle with a list of vehicles submitted by the Contractor;

3) weighing the vehicle on the weight of the transhipment point;

4) the setting of the vehicle or containers in the transhipment square;

5) after loading, reweighing the car with waste;

6) taking the amount by weight by the driver of the vehicle;

7) registration in the BDO electronic system by the Supplier (transferring) of the waste for planning its transfer in this system

The entity required to load unsegregated (mixed) municipal waste onto Contractor's vehicles is Tarnowska Komunalna “TP-KOM” sp. z. o.o. with its registered office in Tarnów Podgórny.

7. When accepting unsegregated (mixed) municipal waste from the handling station, the Contractor is obliged to carry out the service efficiently and as possible impeding the day-to-day operation of the transhipment station.
