The subject of the order is a comprehensive supply of high-methane gas group E for educational institutions and organizational units in the Municipality of Żory. The scope of the contract includes the supply of gaseous fuel for 61 points described in detail in Annex 1 to the draft contract. The amount of gas supplied during the contract period is: approx. 15,197.16 MWh.

1. The subject of the contract is a comprehensive supply of high-methane gas group E for educational institutions and organizational units in the Municipality of Żory. 2. The scope of the contract includes: Supply of gaseous fuel for 61 points described in detail in Annex 2 to the ToR. The amount of gas supplied during the contract period is: approx. 15,197.16 MWh. 3. Gaseous fuel is intended for heating purposes. In the above-mentioned quantity of gaseous fuel for heating purposes, the estimated amount of gas not subject to exemption from excise duty is 6,242,304.00 MWh. Detailed information is included in Annex 2 to this specification. The remaining amount of gas is subject to exemption from excise duty. 4. The supplied gas fuel must meet technical standards in accordance with the provisions of the Energy Law and executive regulations to this Act and Polish Standards. 5. As part of the subject of the contract, the Contractor will be responsible for commercial balancing of gaseous fuel purchased by the Employer. 6. Determining the amount of gaseous fuel is an indispensable element used to select the best offer and does not constitute an obligation on the part of the Employers to purchase gaseous fuel in the given amounts. 7. The expected amount of gas consumption was determined on the basis of consumption from the previous 12 months, taking into account the anticipated quantitative changes in the ordered gas during the term of the future contract. 8. After signing the contract, the Conducting Party will provide the necessary data to perform the supplier switching procedure in the EXCEL electronic version. 9. The Contractor shall make all actions and arrangements with DSO (Polska Spółka Gazownictwa SA) necessary to carry out the supplier switching procedure and effectively start selling gas, including in particular: termination of existing comprehensive contracts, notification of new gas sales contracts to DSO. The Contractor shall perform these activities on the basis of appropriate powers of attorney granted by the Employers together with the conclusion of gas fuel sales contracts. 10. For all collection points, this will be another change of seller. The current gas supplier is an emergency seller, PGNiG Obrót Detaliczny sp. Z o.o. 11. Gas will be sold on the basis of contracts concluded separately by individual organizational units of the Żory Municipality, described in detail in Annex 3 to the ToR.
