The subject of the contract is the provision of maintenance, service and ongoing service of power installations and devices at the headquarters of PSE S.A. in Konstancin-Jeziorna at 165 Warszawska Street.
Detailed specification of the subject of the contract can be found in Parts II and IV of the SWZ. Acting pursuant to Article 133(3) of the Act, the Contracting Authority shall establish requirements for maintaining the confidential nature of information provided to Contractors in the course of the procedure. The following parts of the SWZ are confidential: Part II SWZ – Description of the subject of the contract. The Contracting Authority requires that before submitting the bid, the Contractor makes a site inspection (inspection) of the place for which the works constituting the subject of the contract will be performed and familiarizes itself with the place of their performance, as well as with any restrictions and difficulties related to the implementation of works. The contracting authority indicates that participation in the on-site inspection is obligatory. The Contracting Authority shall reject the offer of the Contractor who did not participate in the on-site inspection.
1) The subject of the contract is the provision of maintenance, service and ongoing maintenance services for power installations and equipment at the registered office of PSE S.A. in Konstancin-Jeziorna, Warszawska 165 Street.
2) Detailed specification of the item of the order can be found in Part II of SWZ and Part IV of SWZ.
3. In accordance with Article 101 (4) of the Act, the Contracting Authority shall allow solutions equivalent to those described in the SWZ by means of standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and paragraph 3 of the Act if they allow to obtain characteristics or parameters no worse than recalled.
Pursuant to Article 101(5) of the Act, the Contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to prove in the tender that the proposed solutions meet the requirements set out in the description of the subject of the contract to an equivalent extent, in particular by means of the evidence referred to in Articles 104-107 of the Act.
4) Acting pursuant to Article 133(3) of the Act, the Contracting Authority shall establish requirements for maintaining the confidential nature of information provided to Contractors in the course of the procedure. The following parts of the SWZ shall be confidential:
Part II SWZ – Description of the subject of the contract.
5) Pursuant to Article 133(3) of the Act, the Contracting Authority does not make public the content listed in point 3 of the SWZ part on the website due to the protection of the confidential nature of the information contained in the SWZ. The file placed on the purchasing platform called "Part II SWZ – Description of the subject of the contract" has been protected with a password.
6) In order to protect the confidential nature of the Confidential Information made available in the course of these proceedings, the Contracting Authority reserves that the password to the confidential information referred to above will be provided after the Contractor submits a confidentiality statement with a qualified electronic signature.
7) The model confidentiality statement is Model No. 11.1 and 11.2 to Part III of the SWZ.
8) The Contracting Authority informs that letters with explanations of the content of the SWZ (if any, will be submitted during the proceedings) will also be published in encrypted form.
9) Pursuant to Article 101(4) of the Act, the Contracting Authority shall allow solutions equivalent to those described in the SWZ by means of standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Act, if they allow to obtain features or parameters not worse than those cited.
10) Pursuant to Article 101(5) of the Act, the Contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to prove in the tender that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent.
11) The Contracting Authority requests the Contractor to indicate, in the tender, the part of the contract the performance of which it intends to entrust to Subcontractors and the Contractor to specify the Subcontractors' companies, if they are already known.
12) Pursuant to the provisions of Article 438 of the Act in conjunction with Article 134(2)(14) of the Act, the requirements for the obligation to employ employees are set out in Part II of the SWZ and Part IV of the SWZ.

14) On-site inspection - the Contracting Authority requires that the Contractor, before submitting the bid, makes a site inspection (inspection) of the place for which the works constituting the subject of the contract will be performed and familiarizes itself with the place of their performance, as well as with any restrictions
and difficulties related to the implementation of works.
15) The contracting authority indicates that participation in the on-site inspection is obligatory. The contracting authority will reject the bid of the Contractor who did not participate in the on-site inspection pursuant to Article 226(1)(18) of the PPL.
