The City of Jena intends to conclude a framework agreement on the leasing of bicycles and the conclusion of a framework service agreement for the handling of bicycle leasing in order to offer its approximately 2,000 active employees covered by collective bargaining agreements a financially attractive offer to switch to or enter emission-free transport and to make an active contribution to climate protection.
The contracting authority and the contractor conclude a framework agreement on the services to be provided to employees covered by collective bargaining agreements in connection with the handling of bicycle leasing. The Client shall not pay the Contractor any remuneration. Without exception, all costs are to be borne by the employees covered by collective agreements and must be included in the corresponding leasing rate of the collectively agreed employee. In addition to the original leasing costs, this also includes insurance and maintenance costs as well as the costs for any malfunctions. These incident costs are also borne by the employees covered by collective agreements and must be covered by appropriate insurance. The contact person for the employees of the Jena City Council in contract, insurance and maintenance issues is regularly the contractor.
The client concludes a leasing framework agreement with the contractor or with a leasing company designated by him, in which the framework conditions for the call-off of individual leasing contracts are regulated.
For each leased bicycle, the client concludes an individual leasing contract with the contractor or the lessor designated by him and a leasing contract (as specified by the client) with the corresponding employees covered by collective bargaining agreements. The rights and obligations regarding the bicycle and deferred compensation are regulated in the transfer contract. If the employee violates the applicable contractual conditions, he is liable for the damage incurred. The client cannot be held liable in this respect.
