It prompts you to specify where Open Source applications are possible.
The contracting authority deliberately merged the contract. The motivation to merge the assignment and not divide it into plots is because:
• the relevant market is comprised of nationally operating companies of such size that they consider the size of this contract to be proportionate and desirable. Assignments are very coherent and the risks are manageable for both tendering service and entrepreneur;
• the reseller's financial resources are limited, as it involves reselling licenses whose costs will not be charged until the customer (the municipality) has activated them. Therefore, the reseller does not run any pre-investment risks and stock risk risks, which is why the task can also be completed by (local) SME companies;
• it represents a financial advantage for both the contracting authority and market parties. For the contracting authority, instead of performing a procurement procedure per license, the framework agreement represents a cost savings. For enrolling parties, a framework agreement saves the transaction costs, because one only has to register once;
• the coherence within the assignment is very high. The assignment concerns the delivery of licenses, but the products can be from different manufacturers. By merging the contract, the contracting authority receives only one contact person to purchase the licenses, which optimises manageability and reduces the admini-strative burden.
The agreement is entered into for a minimum period of two years and a maximum of four years.
The effective date of the agreement is mid-December 2021.
An accelerated European public procurement procedure has been opted for. The motivation for the accelerated procedure is that on 1-1-2022, the merger municipality of Land van Cuijk will become active and must provide its services to residents and organisations. The necessary ICT environment must be set up for this purpose. Due to a lengthy decision-making process which has been delayed due to the later addition of the municipality of Grave, the final agreement of the 1st Chamber for the merger was not given until a late time. The period to realise the ICT environment for Land van Cuijk has become very short which necessitates the accelerated procedure.
