The subject of the contract is the implementation of an investment task in the design and build mode consisting in the preparation of comprehensive design documentation (hereinafter referred to as "Design documentation") along with the author's supervision and the execution of construction works on its basis consisting in the construction of the Kazimierz Deyna Sports and Education Center at 1 Olimpijczyków Starogardzkich Street in Starogard Gdański, implemented on the basis of a functional and utility program (hereinafter referred to as also PFU) and the Concept of arranging the permanent exhibition at the Kazimierz Deyna Sports and Education Centre in Starogard Gdański.

1. The subject of the contract is the implementation of an investment task in the design and build mode consisting in the preparation of comprehensive design documentation (hereinafter referred to as "Design documentation") together with the author's supervision and the execution of construction works on its basis consisting in the construction of the Kazimierz Deyna Sports and Education Center at 1 Olimpijczyków Starogardzkich Street in Starogard Gdański, implemented on the basis of a functional and utility program (called hereinafter also PFU) and the Concept of arranging the permanent exhibition at the Kazimierz Deyna Sports and Education Centre in Starogard Gdański.

2. Note: The scope of roofing of stands, renovation of stands, replacement of lighting on the pitch at Olimpijczyków Starogardzkich Street and thermal modernization of the building at Hallera Street is excluded from the proceedings.

In accordance with the PFU provisions, works related to the construction of the Deyny Centre building, replacement of lighting in the buildings at Olimpijczyków Starogardzkich Street and Hallera Street and the construction of a photovoltaic installation on the buildings at Olimpijczyków Starogardzkich Street and Hallera Street should be designed and carried out.

In addition to the scope of work included in the PFU, a board informing about the grant should be made.

3. The subject of the contract includes both design and construction works (including, m.in electrical, water, landscaping, road, general construction and small architecture), author's supervision and other works necessary for the correct implementation of the subject of the contract. The Contractor bears full and complete responsibility for the correct implementation of the subject of the contract from the moment of signing the contract until the end of the warranty period for the subject of the contract.

4. The Contracting Authority shall attach to the SWZ an additional description of the subject of the contract, which arose as a result of questions asked by the Contractors in the first proceeding regarding the construction of the Kazimierz Deyna Sports and Education Centre.

5. The Contracting Authority shall grant a power of attorney to represent the Contracting Authority before all institutions giving opinions, agreeing and issuing decisions in connection with the implementation of the contract for the development of project documentation.

6. The Contractor shall, on its own and at its own expense:

1) secure geodetic, geological and geotechnical services;

2) perform all measurements, tests, calculations and expert opinions necessary for the proper preparation of the technical documentation;

3) obtains all consents (including for the occupation of real estate for conducting construction works enabling the Contracting Authority to sign a declaration on the right to dispose of real estate for construction purposes), conditions, opinions, permits, decisions and arrangements necessary for the proper design and implementation of the investment and required to obtain an administrative decision constituting a building permit.

7. The Contractor shall be obliged to present multi-discipline pre-design concepts for approval by the Contracting Authority within 4 weeks from the date of conclusion of the contract. The Contractor shall be obliged to take into account all comments of the Contracting Authority and the Supervision in connection with the presented concepts. All further design work must be approved by the Ordering Party and the Supervisor.
