The contract shall be subject to the condition precedent that:
- the BImSchG permit is legally granted and is not associated with conditions that do not allow the wind turbine to operate economically,
- there is a financing commitment from the financing bank
- there is a connection commitment from the network operator
- a surcharge for the EEG remuneration is achieved
