2.2. The object of the order is the purchase of diesel for buses along with delivery to the garage service station in Czołowo, at 1 Kórnicka Street, in a total amount of 800,000 liters ON B7.

2.3. The Ordering Authority has a ground tank with a capacity of 20 thousand. Liters. The Ordering Authority will accept deliveries from Monday to Friday from 7 to 15 o'clock.

2.4. The Contracting Authority allows an increase in the basic volume of 800.000 l ON B7 by 25%, i.e. by 200.000 l at prices from the contractor's offer, taking into account the provisions of the contract (including amendments). The right of options should be understood as an entitlement, not the obligation of the contracting authority. The implementation of the option right may, but does not have to occur, depending on the requisition of the contracting authority and as a result of its disposal in this regard.

2.4. In the event of increased needs of the Employer for diesel, he may exercise his right to options with an appropriate declaration of intent in this regard to the Contractor. Preliminary timetable for using these options in months: 12 (from the award of the contract).

2.5. The Contracting Authority shall pay the Contractor a remuneration for the deliveries made by transfer to the Contractor's bank account within 30 days (criteria for evaluation of tenders — min. 14 days), counting from the date of delivery to the Contractor of the correct invoice.

2.6. Settlements between the Contracting Authority and the Contractor will be held only

in Polish zloty (PLN), excluding foreign currencies.

2.7. The Contracting Authority provides for the possibility of significant changes to the provisions of the Agreement

in relation to the content of the offer on the basis of which the Contractor's choice was made,

in the event of at least one of the circumstances listed below,

taking into account the conditions for their introduction:

2.7.1. Change of delivery date:

1) changes due to force majeure, including natural disasters, atmospheric conditions preventing delivery from being carried out within the time limit;

2. changes following circumstances lying solely on the part of the Contracting Authority, in particular the cessation of delivery;

3) changes resulting from temporary cessation of the production of goods or shortages of goods on the Polish market under contract, including the following action of public administrations,

In the event of any of the circumstances set out in points 1) to 3), the delivery date may be extended accordingly by the time necessary for its proper performance, but not longer than the duration of those circumstances.

2.7.2. Change in the way the benefit is met:

1) changes caused by not redeeming the full amount of ON. In this case, the contract may be extended until the full quantity of ON B7 litres specified

in the contract.

2.7.3. Changes of Contractor's salary:

1) changes caused by the Contractor's provision of promotional discounts.

If the Contractor gives promotional discounts to the customer

during the duration of the contract, the disputes will also apply for that agreement;

2) changes due to an increase in either a reduction in the VAT rate or excise duty. If the change in the VAT rate or excise duty increases the cost of goods on the Contractor's side, the Contracting Authority allows the possibility of increasing the Contractor's remuneration by an amount equal to the difference in the amount of VAT or excise duty paid by the Contractor. If the change in VAT or excise duty will result in a reduction in the cost of goods on the Contractor's side, the Contracting Authority allows the possibility of reducing the remuneration by an amount representing the difference in the amount of VAT or excise duty paid by the Contractor.

2.7.4. The amendment of the provisions of the contract shall require, under the rigor of annulment, to maintain written form unless otherwise provided by SWZ, contract or uPzp. The amendment of the contract at the request of the Contractor requires demonstrating the circumstances authorising this amendment.

2.7.5. The provisions of Article 455 uPzp are also used here,
