The subject of the order is the delivery to GDDKiA of subscription packages for hosted services, rights to update software packages and technical support services packages (hereinafter collectively referred to as products) under a three-year contract lasting until April 30, 2023.

The offered Products are to be standard products - widely available on the market (Commercial off-the-shelf type - COTS).

If the Terms of Reference of the contract has been described in the Terms of Reference by indicating the trademarks, patents or origin, source or specific process (e.g. brand, trademark, manufacturer, supplier) or by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Employer allows offering materials or equivalent solutions, i.e. those that guarantee the implementation of the subject of the contract while obtaining technical parameters not worse than those assumed in the ToR.

Due to the fact that the Act on public procurement law clearly indicates the Contractor as the one who is obliged to demonstrate that the solutions and products offered meet the requirements set by the Employer, the Employer reserves the right, in case of any doubts, to check the full compliance of the products offered with specification requirements. This check will consist of multiple tests in production conditions on the Employer's equipment, using the Employer's peripheral devices, on the Employer's sheets, databases and files with the addition to the Employer's directory service - Active Directory.

To this end, the Contractor shall, at each request of the Employer, deliver to the seat of the Employer within 5 days from the date of receipt of the request, one copy of the indicated item of delivery. Temporary licenses that are fully compatible with those offered may be provided for the software. At the same time, the Employer reserves the right to refer to the official, publicly available websites of the manufacturer of the verified item. A negative result of this check will result in the rejection of the offer, pursuant to art. 89 paragraph 1 point 2 of the Act.

Failure to submit the offered products for testing in the abovementioned deadline will be treated as a negative check result.
