Description:
Collection and transport of municipal waste from owners of inhabited and uninhabited properties located in the Municipal Municipality of Chojnów

The subject of the contract is a service consisting in the collection and transport of municipal waste not segregated (mixed) and separately collected:

(a)paper and paperboard,

(b) glass,

(c)plastics, metals and multi-material packaging waste,

(d) biowaste,

(e)non-segregated (mixed) municipal waste,

(f)expired medicines.

from owners of inhabited and uninhabited real estate located in the city of Chojnów, subject to paragraph 4.1 letter f, to the installation located at 59-220 Legnica, Rzeszotarska 1 Street.

Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority requires employment by the Contractor, Subcontractor or further Subcontractor on the basis of an employment relationship, within the meaning of the Act of 26.06.1974 – Labour Code

. The Contracting Authority does not allow the submission of variant offers. The contracting authority does not provide for a subsection in Article 214(1)(7) of the Public Procurement Law.

The object of the order is the collection and transport of municipal waste from inhabited and non-inhabited properties located within the city of Chojnovna.

The Contractor is obliged to transport the collected waste for the purpose of its management to the Regional Municipal Waste Treatment Installation in Legnica (RIPOK) Rzeszotarska Street, managed by Legnickie Przedsiębiorstwo Gospodarki Komunalnej Sp. Z o.o., Nowodworska 60, 59-220 Legnica. A detailed description of the Subject of the Order can be found in

1) Annex A to SWZ – Description of the Subject of the Order (OPZ) with attachments, i.e.

a) Appendix No. 1 to the OPZ - Lists of waste collection and reception sites and composters),

b) Appendix No. 2 to the OPZ - Sticker - "Poor segregation,

2) Annex B to the SWZ - Model contract,

3) Annex C to SWZ - Resolutions of the Chojnów City Council.

The Contractor may entrust the execution of part of the contract to a subcontractor(s). The Contractor is obliged to secure his bid for a deposit in the amount of: PLN 20,000.00 (in words: twenty thousand zlotys). The security shall be lodged before the closing date for the submission of tenders. The security may be lodged in one or more of the following forms:

1) money, by transfer to bank account No. 13 8644 0000 0000 2121 2000 0130

2) bank guarantees;

3) insurance guarantees;

4) sureties granted by entities referred to in Article 6b(5)(2) of the Act of 9 November 2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws of 2020, item 299).

NOTE: The deadline for the payment of a monetary defect will be accepted for the time limit for the acceptance of the Ordering Party's account.

The security lodged in the form of sureties or guarantees must be lodged as the original of the guarantee or surety in electronic form and meet at least the following requirements:

1) it must include responsibility for all cases resulting in the loss of the bid bond by the Contractor specified in the PPL Act;

2) its content should clearly indicate the guarantor's obligation to pay the entire amount of the security;

(3)it should be irrevocable and unconditional and payable on first request;

4) the term of validity of the surety or guarantee may not be shorter than the date of binding the offer (provided that the first day of binding the offer is the date of submission of tenders);

5) the content of the surety or guarantee should include the name and number of the proceedings in question;

6) the beneficiary of the surety or guarantee is: Gmina Miejska Bolesławiec, Rynek 41, 59-700 Bolesławiec;

7) in the case of Contractors jointly applying for the award of a contract (Article 58 of the Public Procurement Law), the Contracting Authority requires that the surety or guarantee cover its content (i.e. those obliged under the surety or guarantee) of all Contractors jointly applying for the award of the contract or that its content shows that it secures the offer of Contractors jointly applying for the award of the contract (consortium);

The bid of the contractor who does not lodge the bid bond, lodges the bid bond incorrectly or does not maintain the bid bond continuously until the expiry of the deadline for binding the offer or submits an application for the return of the bid bond in the case referred to in Article 98(2)(3) of the PPL Act will be rejected.

The rules for the return and the circumstances of retaining the deposit are set out in Article 98 of the Public Procurement Law.
