The subject of the order is the supply of electricity in the planned amount of approximately 6 582 712 kWh in the period to 31.12.2019 for 527 points of consumption. The beginning of the start of sales is determined not earlier than 1/11/2019.
1) The subject of the contract is the supply of electricity for the purposes of the units specified in the announcement, in the planned amount of approximately 6 582 712 kWh in the period to 31.12.2019 for 527 points of consumption.
2) Detailed information on individual collection points is presented in the summary list constituting Annex 2 to the Specification. The beginning of the start of sales is determined not earlier than 1/11/2019.
3) The declared electricity consumption is an estimate and is used to calculate the offer price.
4) The subject of the contract is described by the following names and codes of the Common Procurement Vocabulary (CPV): 09310000-5 Electricity.
5) The Contractor must have concluded a general contract for the provision of electricity distribution services with the distribution system operator: Energa-Operator SA. The distribution services will be provided on the basis of separate contracts concluded between the contracting authorities (customers / payers) and the distribution system operator (DSO).
6) In Annex 2, in the column "Contract duration / Contract termination period", the indicated period "31/12/2018" means that with respect to these tapping points the supplier will change again and contracts for the supply of electricity are currently concluded for a limited period until December 31, 2018 (the current energy supplier is ENERGA-OBRÓT SA with its registered office in Gdańsk).
7) The Contractor, based on the Power of Attorney granted, will be obliged to submit electricity sales contracts to the appropriate DSO in accordance with applicable regulations on behalf of the purchaser (recipients / payers).
8) The obligation to terminate contracts concluded for an indefinite period lies with the Contractor, subject to the collection points specified in Annex 2 where the contracting authorities themselves terminated the contracts before announcing these proceedings.
9) In the event that, as at the date of the conclusion of the electricity sales contract, the contracting authorities (recipients / payers) do not have valid electricity distribution contracts or if there is a change on the part of the recipient during the term of the contract, the contractor will be required to submit applications for conclusion of distribution contracts and to sign contracts on behalf of and for the ordering parties (recipients / payers) or submitting on behalf of the ordering parties (recipients / payers) a declaration of consent to conclude distribution contracts with the Operator (in accordance with the Operator's IRiESD), for which the contractors will be granted appropriate powers of attorney.
10) For all collection points, the awarding entities (payers / recipients) have the status of recipient, therefore they are entitled to purchase energy from the seller of their choice / art. 4j paragraph 1 of the Energy Law of 10.4.1997.
