Description:
Successive deliveries of pharmaceuticals to the Company Pharmacy of the Prison in Czarne

The subject of the contract are: successive (according to orders) deliveries of pharmaceutical products to the Pharmacy of the Penitentiary in Czarne, Pomorska 1, 77-330 Czarne, in accordance with the assortment indicated in Appendix No. 1 (order price form).

Package I: medicines

The subject of the contract are: successive (according to orders) deliveries of pharmaceutical products to the Pharmacy of the Penitentiary in Czarne, Pomorska 1, 77-330 Czarne, in accordance with the assortment indicated in Appendix No. 1 (order price form).

2. The Contractor is obliged to offer only an assortment that holds a registration certificate or a certificate of marketing authorisation in the Republic of Poland.

3. The offered medicines must have documents allowing for marketing and use on the territory of the Republic of Poland in accordance with the requirements set out in the Act of 6 September 2001. Pharmaceutical Law (Journal of Laws of 2022, item 2301, as amended).

4. The offered medical devices must have documents valid on time allowing for marketing and use on the territory of the Republic of Poland in accordance with the provisions of the Act of 7 April 2022 on medical devices (Journal of Laws of 2022, item 974)

5. At each written request of the contracting authority, the contractor shall provide, no later than within 3 working days from the date of the request, current documents confirming the release of the delivered product for marketing and use (electronic form is allowed).

6. The item of the order delivered in the implementation of the contract must be purchased in the official channel of sale.

7. The item of the order delivered under this contract must be factory new, unused, unregenerated, without physical and legal defects and bearing no signs of its prior use or damage.

The subject of the order must be delivered in pre-closed packaging, having the characteristics of the original packaging, together with information on the manufacturer's indications as to the characteristics of the subject of the order, safety rules and expiry dates. These requirements, in Polish, must be on the package or on the leaflet in accordance with the provisions in force.

8. If the description of the subject of the contract indicates the trade name of the company, goods or product, the contracting person - with regard to the parameters indicated directly in the tender documentation, whether the data (technical or any other) identifying indirectly or directly the goods or product - allows equivalent solutions (generics) consistent with the technical data and parameters contained in the documentation. As equivalent solutions, it is necessary to understand solutions characterized by parameters not inferior to those required and found in the documentation. The Contracting Authority under the concept of equivalent products understands products containing the same active substance at the same dose and having the same indications and the same route of administration in the absence of differences in pharmaceutical form, the bioequivalence of which has been confirmed by appropriate bioavailability studies .

9. If the contractor offers equivalent pharmaceutical products (generics) under the assortment offered by the contractor, the Contracting Party shall pay for the equivalent products (generics) a price not higher than the price of the product resulting from the contract concluded.

10. A Contractor who offers equivalent pharmaceutical products (generics) of a different packaging size than those specified in Annex No 1 to SWZ, in order to preserve the total required quantity of unit items (tablets, ampoules, etc.), the quantity of packages should be converted and rounded up to full packaging.

11. The offered subject of the contract on the day of submission of tenders may not be intended by the manufacturer for withdrawal from production or sale.

12. The validity period of the offered products may not be shorter than 12 months (counting from the date of delivery) until the end of the shelf life, unless the Ordering Party agrees to accept the product with a shorter expiry date.

13. The Ordering Party shall not allow:

1) offer dietary supplements,

2) insulin changes,

3) changes in the size of packaging ointments and creams.

Package II: drugs containing narcotic drugs or psychotropic substances

The subject of the contract are: successive (according to orders) deliveries of pharmaceutical products to the Pharmacy of the Penitentiary in Czarne, Pomorska 1, 77-330 Czarne, in accordance with the assortment indicated in Appendix No. 1 (order price form).

2. The Contractor is obliged to offer only an assortment that holds a registration certificate or a certificate of marketing authorisation in the Republic of Poland.
