2. Indicative offer
If there is not enough space available to enter into negotiations with each of the suitable bidders whose settlement projects meet the minimum requirements, the suitable bidders are requested to submit indicative offers. In the indicative offer, requests regarding the location of the settlement area can already be expressed.
In the course of this request, JWP-M will inform the bidders of the non-discriminatory evaluation criteria selected on the basis of JWP-M's procurement needs, on the basis of which the best bidder leasehold agreement and / or the best bidder lease agreement will be determined. In the event of a tie, these bidders will be renegotiated and again asked to submit an offer. The minimum conditions shown such as minimum fees etc. are not negotiable.
It is clarified that indicative offers for the conclusion of a leasehold contract are always given priority. If both indicative offers for the conclusion of a leasehold agreement and indicative offers for the conclusion of a lease agreement are received, 2 different rating groups are created (leasehold agreement // lease agreement). 3. Negotiations
By evaluating the indicative offers, the bidder is selected with whom negotiations will primarily take place and the area to be reserved for this bidder will be determined. The remaining areas are negotiated with the remaining bidders in accordance with the rank determined by evaluation. A period is defined for the respective negotiation, during which the respective area is not otherwise marketed by JWP-M (reservation period). JWP-M will, based on the complexity of the settlement concept of the best bidder (and, if applicable, the remaining bidder / s), determine an appropriate reservation period. This is usually about 6 months. JWP-M reserves the right to extend the reservation period appropriately at its discretion.
