The aim of the present procurement project is the award of a framework agreement on the provision of bicycles by way of leasing by means of deferred compensation for the employees of the Free State of Bavaria, the Bavarian State Forests and certain university hospitals of Bavaria ("JobBike Bayern") for a period of six years between the clients as lessees on the one hand and an expert and efficient service provider in addition to a lessor as Financing partners, on the other hand. Both the service provider and the lessor become joint contractors of the framework agreement. The framework agreement regulates the basic service relationships between the client and the contractor and also contains the essential requirements for the individual leasing contracts to be concluded separately on the one hand and for the leasing and deferred compensation contracts for use by the employees on the other.

The aim of the clients is to live up to the role model function of the public sector in climate protection and to meet the requirements of the Bavarian State Government for a climate-neutral administration by 2030 in accordance with Art. 3 para. 1 sentence 1 of the Bavarian Climate Protection Act (BayKlimaG) or by 2028 in accordance with § 1 No. 3 a) aa) of the draft law amending the Bavarian Climate Protection Act (BayKlimaÄndG-E) and the climate neutrality of Bavaria by 2050 in accordance with Art. 2 para. 2 BayKlimaG or by 2040 in accordance with § 1 No. 2 b) BayKlimaÄndG-E. In addition, the health of the employees of the clients is to be promoted and, according to the government declaration of 21 July 2021, cycling is to be increased to around 20 percent by 2025.

To this end, the clients intend to introduce an attractive offer by means of a framework agreement on the provision of bicycles by way of leasing by deferred compensation with a cooperation partner within the framework of the "JobBike Bayern" project.

Key performance items include:

(1) Support in the introduction of the offer to the clients within the framework of the project "JobBike Bayern";

(2) Realization of a digital ordering and processing process for bicycle leasing by providing and operating an online platform taking into account the specifications for the IT interfaces of the client, in particular by connecting the online platform of the contractor to the existing Internet portal "Mitarbeiterservice Bayern" of the Free State of Bavaria in accordance with the required functionalities and creation of an IT interface between the online platform of the contractor and the client via the State Office of Finance;

(3) Provision of bicycles and leased accessories (e.g. bicycle lock, lights, pedals, etc.) at the employee's choice at a dealer from the Contractor's network of contractors;

(4) Provision of insurance benefits for defined insurance claims and handling of incident management as well as

(5) Execution of services such as annual maintenance and inspection services at a dealer from the contractor's network of contractual partners.

The adjustment of the legal framework in the Free State of Bavaria is currently being prepared in order to ensure a legal basis for the conversion of remuneration for the relevant groups of persons at the time of the award.

At the time of this announcement, the contracting authorities assume that the necessary legal basis for the conversion of remuneration for the approximately 237,000 civil servants, including judges, has been adopted and entered into force at the time the contract is awarded.

On the other hand, with regard to employees covered by collective agreements, the contracting authorities assume that the necessary legal basis for the conversion of remuneration for the approximately 154,000 employees will probably only be adopted and entered into force after the contract has been awarded.

The award of a contract for the framework agreement and for the retrieval of services for civil servants, including judges, is subject to the proviso that the corresponding legal basis for the implementation of the deferred compensation has entered into force at that time. Furthermore, in the event of a contract being awarded for the framework agreement, the contracting authorities reserve the right that the retrieval of services for the employees is optional and only takes place when the corresponding legal basis for the conversion of remuneration has also come into force for this group of persons.

The contracting entities intend to conclude the framework agreement as a basis for the provision of services for a period of six years. The clients reserve the right to call off at least 2,000 to a maximum of 782,000 individual leasing contracts during the entire term of the framework agreement.
