Description:
“Successive supply of liquid fuels for the purposes of the Municipal Services Company sp. z o.o. in Tarnów in 2022”

The subject of the order is the successive supply of liquid fuels, including gasoline pb 95, diesel fuel and fuel oil for vehicles and motor equipment Company Komunal Services sp. z o.o. in Tarnów in 2022.

SUCCESSIVE PURCHASE OF PETROL PB 95 AT THE SERVICE STATION CONTRACTOR

The subject of this part of the order is the successive purchase in 2022 by the Ordering Party of unleaded petrol Pb 95 at the Contractor's service station in an estimated total amount of up to 17.000 liters.

1. Requirements for the order

1) petrol Pb 95 must comply with the quality requirements set out in the Act of 25 August 2006 on the system for monitoring and controlling the quality of fuels, including the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels and to comply with the standard PN-EN 228+A 1:2017 -06. In the event of a change in regulations or standards in this regard during the execution of the order, petrol Pb 95 supplied by the Contractor shall comply with the amended standards and regulations.

2) The Contractor shall submit, at every request of the Contracting Authority, a certificate of petrol quality Pb 95 or a document equivalent to such quality certificate (in the form of the original or a copy confirmed as conformity with the original) confirming that petrol Pb 95 meets the quality parameters specified in the SWZ,

3) In case of doubts as to the quality of petrol Pb 95, the Contracting Authority has the right to carry out its quality checks in the manner and on the principles laid down in the Regulation of the Minister of Economy of 1 September 2009 on the method of sampling liquid fuels and liquid biofuels. In the field of verification of the quality of the Pb95 gasoline collected, the Contracting Authority shall be entitled to order the test to an independent accredited laboratory of his choice. The test results of a sampled gasoline Pb 95, issued by an accredited laboratory, are binding to the parties and are not subject to complaint.

4) Any complaint by the Contracting Authority in respect of the quality of gasoline sold Pb 95, the Contractor is obliged to arrange within 3 days from the date of their notification by the Ordering Party. The Contractor's failure to respond to the notified complaint within this period will be considered to be the recognition of the Contractor's complaint by the Contractor. The payment of a complaint will be made at the Contractor's expense by allowing the Ordering Party to collect Pb 95 defect free gasoline in the same quantity as the Pb 95 petrol covered by the complaint was collected.

5) The Contractor shall be liable in general terms for damage to the Contracting Authority in the event that the collected petrol Pb 95 does not have parameters in accordance with the applicable standards and regulations. If quality defects of the supplied petrol Pb 95 are found, the Contractor shall be obliged to repair the damage (failure of vehicles/equipment, etc.) caused by the Ordering Party's use of a qualitatively defective petrol Pb 95.

2. Place, method of consumption of petrol Pb 95 and the rules of its registration

1) Refueling (consumption) of petrol Pb95 by the Contracting Authority is required to be provided at least 1 Contractor service station planted from the Contracting Authority located at

KBath 4b Street in Tarnów in a distance of not more than 3 km counting on paved roads - calculated using the data contained on the website https://www.google.com/maps.

The Contractor in the Offer Form (Annex No 1 to SWZ) shall indicate the service station provided for the execution of the order (petrol consumption Pb95 by the Ordering Party), specifying the place of its location (address) and the distance from the Ordering plant at KBath 4b Street in Tarnów calculated using data contained on the website https://www.google.com/maps. The Contracting Authority shall verify the distance provided by the Contractor in the offer of the service station distance also using the data contained on the website https://www.google.com/maps.

SUCCESSIVE DELIVERY FOR MICROSTATION and SURVETING PROTECTIVES

The subject of this part of the order is the successive delivery in 2022 of diesel fuel (for the propulsion of compression-ignition engines) to the Ordering fuel station located at KBath Street 4b in Tarnów and to fuel tanks of 1m3 each located at 31 Komunalna Street in the city of 31 in Tarnów, estimated in total quantity: up to 250 m3.

Requirements for the order:

1) The diesel supplied under the order must comply with the quality requirements set out in the Act of 25 August 2006 on the system for monitoring and controlling the quality of fuels, including the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for fuels Liquid and comply with standard PN-EN 590+A 1:2017 -06. In the event of a change in standards and regulations in this respect, the diesel shall comply with the amended standards and regulations.

2) The Contractor shall provide the Ordering Authority with a diesel not containing biocomponents. In situations objectively independent of and documented by the Contractor (e.g. the lack of availability of diesel at the time of the contract), the possibility of delivering a B7 diesel fuel containing 7% of the biocomponent admixture, with the Contractor having to report in advance This fact to the contracting officer to the e-mail address stating the actual cause and the presentation of appropriate evidence.

3) In case of doubts as to the quality of diesel delivered, the Ordering Party has the right to carry out quality control of the diesel fuel supplied in the manner and on the principles laid down in the Regulation of the Minister of Economy of 1 September 2009 on the method of sampling fuels liquid and liquid biofuels. In that case:

(a) The Contracting Authority shall take, in the presence of a representative of the Contractor, a sample of the supplied seizure oil and refer it for examination to an accredited laboratory of his choice, at the expense of the Contractor,

(b) A sample of seizure oil shall be taken up to 2 litres per container supplied by the Contractor,

c) The container with the oil sample shall be secured with seals with imprints of authorised representatives of the Contracting Authority and Contractor. For this circumstance, a protocol for sampling shall be drawn up in duplicate, one for each party,

(d) The test results of the seizure oil sample taken by the accredited laboratory shall be binding to the parties and shall not be subject to complaint,

(e) In the event of an accredited laboratory finding that the supplied diesel fuel does not meet the required quality standards, the Contractor must collect the defective diesel from the Contracting Authority at his cost and risk and supply in the same quantity diesel fuel that meets the required parameters qualitative - within 24 hours of receipt of the results from the accredited laboratory,

4) The Contracting Authority reserves the right to carry out, before unloading the supplied batch of diesel fuel, a pre-inspection of the oil-transporting autocystern, including:

(a) check that the autocystern does not have traces of leaks,

(b) checking the condition and purity of the autocystern drain wires,

(c) verify that the autocystern corresponds to the general health and safety regulations,

(d) sampling of diesel fuel from the autocystern drain valve for visual assessment whether the oil is clear, without suspensions, solids or water. The limit size to which samples are sampled is 5 litres of diesel. Oil samples will be taken from the Contractor's autocystern in accordance with the standard PN-EN ISO 3170:2006 set out in the Annex to the Regulation of the Minister of Economy of 1 September 2009 on the method of sampling liquid fuels and liquid biofuels.

SUCCESSIVE SUPPLY OF FUEL OIL TO THE PROCURING TANK

The subject of this part of the order is the successive delivery in 2022 of fuel oil to the Ordering tank located at KBath 4b Street in Tarnów in an estimated total quantity: up to 3 m3.

1. Other requirements:

1) The fuel oil supplied under the order must have the physico-chemical characteristics specified in the Polish Standard “PN-C- 96024:2011 Petroleum products — Heating oils and comply with the quality requirements of the Regulation of the Minister of Economy of 1 December 2016 on requirements qualitative content of sulfur for oils and the types of installations and conditions under which heavy fuel oils will be used. In the event of a change in standards and regulations in this respect, the heating oil supplied under the order must comply with the revised standards and regulations.

2) In the case of doubts as to the quality of fuel oil supplied, the Contracting Party has the right to carry out quality checks on fuel oil supplied in the manner and on the principles laid down in the Regulation of the Minister of Economy of 21 February 2007 on the method of sampling light oil fuel, heavy fuel oil and oil for the engines of inland navigation vessels. In that case:

(a) The Contracting Authority shall take, in the presence of the Contractor's representative, a sample of the supplied fuel oil and refer it to an accredited laboratory of his choice at the Contractor's expense,

(b) A sample of the oil shall be taken in an amount of up to 2 litres per container supplied by the Contractor.

c) The container with the oil sample shall be secured with seals with imprints of authorised representatives of the Contracting Authority and Contractor. For this circumstance, a sampling protocol shall be drawn up in duplicate of one for each party.

(d) The results of tests of the collected oil sample issued by the accredited laboratory shall be binding to the parties and shall not be subject to complaint,

(e) If an accredited laboratory finds that the supplied fuel oil does not meet the required quality standards, the Contractor must collect from the Contracting Authority at his cost and risk defective fuel oil and supply in the same quantity fuel oil satisfying the quality parameters, in 24 hours from the date of receipt of the results from the laboratory.

3. The Contracting Authority reserves the right to carry out before unloading the supplied batch of fuel oil a pre-inspection of the autocystern covering:

(a) check that the autocystern does not have traces of leaks,

(b) checking the condition and purity of the autocystern drain wires,

(c) verify that the autocystern corresponds to the general health and safety regulations,

(d) sampling of fuel oil from the autocystern drain valve for visual assessment whether the oil is clear, without suspensions, solids or water; the limit size for which samples are taken is 5 litres ON.

4) The Contracting Authority reserves the right to refuse to accept the supplied batch of fuel oil in the event of:

(a) the Contractor's failure to supply the required documents (a quality certificate or document equivalent to a quality certificate - in the form of an original or a copy confirmed for conformity with the original) confirming that the supplied fuel oil meets the quality parameters set out in the SWZ, the presentation by the Contractor of these documents incomplete or improper,

(c) reservations arising from the initial inspection referred to in point 3, and in particular if the presence of water in the diesel fuel is found in an unstandard quantity or foreign impurities in the diesel sample sampled.
