1. The subject of the contract is the Renewal of the manufacturer's technical support for Nagios XI software.

2. This contract is a contract awarded in lots, each subject to a separate procedure.

3. The contract is included in the procurement plan published in BZP under number 2.2.13.

4. The contracting authority does not provide for the cancellation of the procedure in the cases specified in Article 257 of the PPL.

1.The subject of the contract is the renewal of the manufacturer's technical support for the Nagios XI software (renewal of support to the existing license allowing access to new versions and security patches for a period of 12 months).

2. A detailed description of the subject of the contract and the scope is indicated in Part III of the SWZ and in Part IV of the SWZ - Draft Provisions of the Agreement.

3. The deadline for delivery of documents confirming the extension of the manufacturer's technical support - the execution of the order is a maximum of 10 calendar days from the date of conclusion of the contract, while the Contractor will be obliged to perform the order within the time limit declared in the Offer Form (Form OF.0) (Note !! It is a criterion for the evaluation of tenders).

4.The deadlines for the performance of individual obligations of the Contractor, constituting the subject of the contract, are specified in the Draft Provisions of the Agreement constituting Part IV of the SWZ and in the description of the subject of the contract indicated in Part III of the SWZ.

5. The Ordering Party does not require a bid bond.

6.The Contracting Authority does not require the Contractors to lodge a performance bond.

7.The Contracting Authority shall not request the Contractor to submit the said means of proof together with the bid and the Contracting Authority shall not provide for supplementing the evidence referred to in Article 107(2) of the PPL.

8. The Ordering Party does not reserve in the description of the subject of the contract accessibility for the disabled and design for all users.

9. The Contracting Authority shall not reserve the obligation for the Contractor to personally perform key tasks related to the implementation of the subject of the contract.

10. The Contracting Authority does not reserve the obligation for individual Contractors jointly applying for the award of the contract to perform key tasks related to the implementation of the subject of the contract.

11. Due to the fact that the activities performed by the persons indicated for the performance of the public contract do not consist in the performance of work within the meaning of Article 22 § 1 of the Labour Code, the Contracting Authority does not specify the requirement for the Contractor or subcontractor to employ persons on the basis of a contract.

12.The Contracting Authority shall not require the Contractor to employ the persons referred to in Article 96(2)(2) of the PPL.

13. The Contracting Authority shall not reserve the requirements related to the performance of the contract referred to in provision 96(1) of the PPL.

15. The contracting authority provides for the procedure to be conducted using the procedure set out in Article 139 of the PPL.

16. The Contracting Authority does not provide for a pre-tender meeting with the Contractors; conducting an electronic auction referred to in Articles 227 to 238 of the PPL; the possibility of awarding contracts referred to in Article 214(1)(8) of the PPL; reimbursement of the costs of participation in the proceedings, except for the situation referred to in Article 261 of the PPL; the requirement or possibility to submit tenders in the form of electronic categories or to attach a katal. electronic to the offer of Article 93 of the PPL.
