1. The subject of the contract is construction works consisting in the design and construction of fermentation installations as well as sheds and storage boxes at the premises of ZUOK "Orli Staw".

2. A detailed description of the subject of the contract is described by means of a functional and utility program constituting part II of the ToR.

3. The procedure is conducted in an open tender in accordance with art. 39 of the Public Procurement Law

4. The proceedings are conducted in Polish in electronic form only via the purchasing platform at:

Correspondence addressed to the Employer in a manner other than to the address given above will not be considered.

1. The material scope covered by these proceedings includes in particular:

1) preparation of the Technological Project - Episode I;

2) execution of pre-design works, design, obtaining a building permit - Episode II;

3) construction of a fermentation plant with a shelter - Episode No. III;

4) construction of a biogas installation with cogeneration - Section IV;

5) construction of storage boxes - Episode No. V;

6) construction of the power grid together with the TR3 Transformer Station - Section VI;

7) construction of technical networks and infrastructure - Episode No. VII;

8) construction of a communication and road system as well as green areas - Section VIII;

9) finishing and furnishing the boiler room in the social building - Episode No. IX;

10) Final Trials, obtaining occupancy permit and other documents - Episode No. X;

11) Operation Trials - Episode No. XI.

2. The plant is operated during the following hours:

1) Monday-Friday 06:00 to 22:00

2) (sporadically) Saturday 06:00 to 14:00

The Contractor with the consent of the Employer may also work outside the above working hours of the Plant. In such cases, the Contractor will be obliged to cover all costs resulting therefrom and incurred by the Employer related to the performance of work or duties by third parties or employees of the Employer.

3. The Contractor under the subject of the contract is also required to perform all preparatory and cleaning works, maintain the construction site, prepare information and BIOZ plan, organize the construction site, organize traffic, provide geodetic service, meet the conditions set out in the opinions of bodies, arrangements, decisions , performing all tests, tests and start-ups, after completion of the Works to restore the area and pavement adjacent to the object to its previous state, and other activities necessary to perform the subject of the contract.

NOTE: Due to restrictions on the number of characters in other parts of this announcement, the Employer informs in this section that:

1. The Contractor is obliged to lodge a security deposit in the amount of PLN 920,000.00 (say: nine hundred twenty thousand zlotys 00/100) before the deadline for submission of Offers.

2. The form of lodging the bid bond shall be chosen by the Contractor from those provided for in art. 45 item 6 of the PPL Act.

3. The bid bond must secure the submitted Bid throughout the entire period of being bound by the Bid, i.e. 60 days, counting from the date of the bid submission deadline.

4. The Contractor submits the Bid by attaching to the Employer's Platform:

1) the completed Offer Form (Annex 1 to IDW - Part I of the Terms of Reference) together with attachments to the Offer Form and Technical Offer (referred to in item 12.8. IDW - Part 1 of the Terms of Reference),

2) completed statement (EAT), referred to in point 12.1. IDW - I part of the Terms of Reference;

3) power of attorney to represent all Contractors jointly applying for the award of the contract (if applicable),

4) power of attorney - if the offer is submitted by the Contractor's attorney;

5) the document referred to in point 13.2. IDW - I part of the Terms of Reference (if applicable);

6) proof of payment of the bid security referred to in point 16 IDW,

- to be prepared in accordance with the rules set out in IDW.

5. A detailed description of the way the Offer is prepared and the method of examining and evaluating the submitted offers is included in point 18 and 23 IDW - I part of the Terms of Reference.

6. The Awarding Entity informs that in the case of these proceedings it applies art. 24aa of the PPL Act.
