The subject of the contract is the purchase of electricity for the needs of electricity consumption points of the Krosno Waterworks in the period from 01.01.2023 to 31.12.2023.

The purchase of electricity does not include the provision of an electricity distribution service

1. The subject of the contract is the purchase of electricity for the needs of the electricity consumption points of the Krosno Waterworks (WK) listed in Annex 4 to the IDW.

2. PPE are equipped with generating installations, from which energy is used for the Own Needs of the Ordering Party's facilities:

1) the surplus energy generated in the installations, which will not be consumed as part of the current needs of WK, is returned to the power grid of PGE Dystrybucja S.A. The estimated amount of energy that will not be consumed within 12 months is specified in Annex 4 to the IDW

2) The Contracting Authority shall conclude a contract with the selected Contractor for the purchase of surplus electricity that has been produced and not consumed. The contract will be concluded on the model generally applicable to a given Contractor.

3) Method of determining the repurchase price of electricity generated in the Ordering Party's photovoltaic installation.

The Contractor undertakes to repurchase the electricity generated in the photovoltaic installation at a price of 90% * of the weighted average monthly BASE price for the Day-Ahead Market published on the www.tge.pl in the "Monthly Report" by the Polish Power Exchange (TGE) for a given billing cycle.

3. The seller of electricity to the facilities listed in Annex 4 is currently MPGK Krosno Sp. z o.o., with which WK also settles the surplus of energy returned to the DSO network.

4. The purchase of electricity shall not include the provision of an electricity distribution service.

5. The purchase of electricity will take place under the conditions set out in the Energy Law of 10 April 1997 (consolidated text Journal of Laws of 2021.716, as amended), implementing regulations to this Act, and in particular the Regulation of the Minister of Economy of 4 May 2007 on detailed conditions for the functioning of the power system (Journal of Laws of 2007 No. 93, item 623 from late. as amended), tariff for electricity distribution services of the relevant Distribution System Operator (DSO Tariff), Instructions for Operation and Operation of the Distribution Network (IRiESD) and generally applicable legal regulations.

6. The demand for electricity is approx. 2.9 GWh.

The Ordering Party requires that the Contractors applying for the award of this contract have a valid and binding General Distribution Agreement concluded with the relevant Distribution System Operator - PGE Dystrybucja S.A.
