1. The subject of the contract is the sale, delivery and commissioning of medical devices in the scope of the following tasks:
Rump. 1. Medical Lasers-Urological Laser-1 pcs.
Rump. 2. Operating tables-Urology operating table-2 pcs.
Rump. 3. X-ray apparatus - 3D digital pantomograph - 1 pc.
and training of medical personnel in the handling of the subject matter of the contract and training of the contracting authority's technical staff
2.The contracting authority provides for the application of the procedure referred to in Article 139(1) of the Public Procurement Law, i.e. the contracting authority will first examine and evaluate the bids, and then it will make a subjective qualification of the Contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure
3.Procedure for awarding the contract:
The procedure is conducted in an open tender procedure pursuant to the provisions of the Public Procurement Law (PPL) with the application of Article 138(2)(2) (PPL)

2.Tender evaluation criteria for all tasks - parts:
How offers are evaluated:
A) - Criterion: price - indicator C - will be calculated according to the formula:
C = ( Cn / Cb ) x 60 – for task no: 1, 2, 3,
Where:
Cn - gross price of the cheapest offer.
Cb - gross price of the examined offer.
B) - Criterion: warranty period – indicator G – will be calculated according to the formula.
G = ( Gp / Gmax ) x 20 – for task no. 1.
G = ( Gp / Gmax ) x 40 – for task no. 2,3,
Where:
Gp – the number of points received by the examined offer.
Gmax – the maximum number of points to be awarded under the warranty period criterion.
Gmax = 24 pts.
If a warranty period of 24 months is offered, the contractor receives 0 points.
Description assessed under the criterion - guarantee period for task no. 1, 2, 3:
Method of awarding points:
For each additional month above the required value (24 months) the Ordering Party will award 1 point, i.e.
- for an additional 1 month – 1 point.
- for an additional 2 months – 2 points.
- for an additional 3 months – 3 points.
- for an additional 4 months – 4 points.
- for an additional 5 months – 5 points.
- for an additional 6 months – 6 points.
- for an additional 7 months – 7 points.
- for an additional 8 months – 8 points.
- for an additional 9 months – 9 points.
- for an additional 10 months – 10 points.
- for an additional 11 months – 11 points.
- for an additional 12 months – 12 points.
- for an additional 13 months – 13 points.
- for an additional 14 months – 14 points.
- for an additional 15 months – 15 points.
- for an additional 16 months – 16 points.
- for an additional 17 months – 17 points.
- for an additional 18 months – 18 points.
- for an additional 19 months – 19 points.
- for an additional 20 months – 20 points.

Attention:
The warranty period must be specified to the nearest month. If the warranty period is specified with an accuracy other than one month, the customer will round the number of points down.
1 month = 30 days.
In the case of offering a period longer than 48 months, the Ordering Party will award 24 points.
C) - Criterion: technical parameters – indicator P – will be calculated according to the formula:
P = ( Pp / Pmax ) x 20 – for task no: 1
Where:
Pp – the number of points received by the examined offer.
Pmax – the maximum number of points to be obtained under the criterion of technical parameters.
Pmax = 35 pts.
D) - Evaluation of the offer – the O indicator will be calculated according to the formula:
O = C + G + P. - for task no: 1.
O = C + G. - for task no: 2, 3.

A: Offer rating indicator.
C: price indicator - for task no: 1, 2, 3.
G: Warranty period indicator - for task no.: 1, 2, 3.
P: indicator technical parameters - for task no: 1.

2. In this part of the announcement, the Contracting Authority also specifies the further grounds for exclusion.
GROUNDS FOR EXCLUSION OF CONTRACTORS - CONTINUED:
5) if the contracting authority can conclude, on the basis of credible indications, that the contractor has concluded an agreement with other contractors to distort competition, in particular if belonging to the same capital group within the meaning of the Act of 16 February 2007 on the protection of competition and consumers have submitted separate tenders, partial tenders or applications for admission to the proceedings, unless they show that they have prepared these offers or applications independently of each other;
6) If, in the cases referred to in Article 85(1), there has been a distortion of competition resulting from the previous involvement of the contractor or an entity which belongs to the same capital group with the contractor within the meaning of the Act of 16 February 2007 on competition and consumer protection, unless the distortion of competition caused by this can be eliminated by means other than by excluding the contractor from participation in the procurement procedure.
7). The following shall be excluded from the public procurement procedure or competition conducted pursuant to the Act of 11 September 2019 – Public Procurement Law:
a) a contractor and a participant in a competition listed in Regulation 765/2006 and Regulation 269/2014 or entered on the list on the basis of a decision on inclusion on the list determining the application of the measure referred to in Article 1(3) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and for the protection of national security (Journal of Laws of 2022, item 835);
b) a contractor and a participant of a competition whose beneficial owner within the meaning of the Act of 1 March 2018 on Counteracting Money Laundering and Financing of Terrorism (Journal of Laws of 2022, items 593 and 655) is a person listed in Regulation 765/2006 and Regulation 269/2014 or entered on the list or being such a beneficial owner since 24 February 2022, if it has been entered on the list on the basis of a decision on inclusion on the list determining the application of the measure referred to in Article 1(3) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and for the protection of national security (Journal of Laws of 2022, item 835);
c) a contractor and a competition participant whose parent undertaking within the meaning of Article 3(1)(37) of the Accounting Act of 29 September 1994 (Journal of Laws of 2021, items 217, 2105 and 2106) is an entity listed in Regulation 765/2006 and Regulation 269/2014 or entered on the list or being such a parent undertaking as of 24 February 2022, provided that it has been entered on the list on the basis of a decision on inclusion on the list determining the application of the measure referred to in Article 1(3) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and for the protection of national security (Journal of Laws of 2022, item 835).
8). The exclusion shall be for the duration of the circumstances referred to in paragraph 7.
