1. Name of the subject of the contract: Purchase of electricity for a purchasing group created by the Municipality of Oborniki.
2. Electricity shall be supplied in accordance with applicable law, in particular under the conditions laid down in the Act of 10 April 1997. Energy Law (Journal of Laws 2022.1385, as amended) and executive regulations to this Act.
3. The order covers the supply of electricity in the amount of 8 122 629 kWh from 01.01.2024 to 31.12.2024 to electricity consumption points in accordance with Appendix 1 of this description.
4. The supply of electricity will be carried out on the basis of the contract for the sale of electricity referred to in Article 5(2)(1) of the Energy Law.
5. This contract does not cover the provision of electricity distribution services.

4. The supply of electricity will be carried out on the basis of the contract for the sale of electricity referred to in Article 5(2)(1) of the Energy Law.
5. This contract does not cover the provision of electricity distribution services.
6. Quality requirements:
1) The supply of electricity shall take place under the conditions specified in the provisions of the Energy Law Act of 10 April 1997 and in accordance with the implementing regulations issued to that Act. Distribution services will be provided on the basis of a separate agreement concluded by the Ordering Party with the relevant Distribution System Operator (DSO).
2) The Contractor is obliged to act as an entity responsible for commercial balancing for electricity sold as part of the subject of the contract.
3) The Contractor is obliged to have agreements with the Distribution System Operator, i.e. ENEA OPERATOR Sp. z o.o., valid for the entire period of this order, enabling the conclusion of effective contracts for all consumption points covered by the Terms of Reference, operating in the premises of the Ordering Parties, enabling the sale of electricity via the DSO distribution network to the electricity consumption points specified in Appendix No. 1.
7. The Ordering Party informs that for all points of electricity consumption, the procedure of changing the seller is carried out once again.
8. All consumption points have separate contracts for the sale of electricity (for a definite period until 31 December 2023) and a contract for the provision of distribution services (for an indefinite period).
