Construction work consisting in the renovation of sanitary facilities and water supply and sewage systems in building No. 1 at Al. Niepodległości 218 in Warsaw, case no. 16/ZP/22.

1. The subject of the contract is a critical construction work consisting in the renovation of sanitary facilities and water installations. – can. in building No. 1 (public sanitary facilities) at Al. Niepodległości 218 in Warsaw – task No. 80133 entitled "Renovation of bathrooms in building No. 1" Al. Niepodległości 218.

2. Building No. 1 was included in the municipal register of immovable monuments of the Capital City of Warsaw on the basis of the order of the President of the m.st of Warsaw No. 2998/2012 on the establishment of a register of monuments of the Capital City of Warsaw. The public utility building in question is located in a closed area within the meaning of the Act of 17 May 1989. Geodetic and cartographic law.

3. A detailed description of the subject of the contract is classified design documentation, technical specifications for the execution and acceptance of construction works and a bill of quantities for the renovation task No. 80133.

4. Pursuant to Article 95(1) of the Public Procurement Law, the contracting authority shall specify in the contract notice or procurement documents for services or construction works the requirements for employment by the contractor or subcontractor on the basis of the employment relationship of persons performing the activities indicated by the contracting authority in the scope of the performance of the contract if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2020, item 1320).

In the implementation of the subject of the contract, there are the following types of activities related to the performance of construction works, i.e. activities carried out by persons performing construction works on the construction site in accordance with Article 3(7) of the Construction Law, which require employment on the basis of an employment contract:

• activities related to the preparation of the construction site (CPV 45100000);

• activities related to the erection of complete construction works or parts thereof (45200000);

• construction installation activities (CPV 45300000);

• activities related to the execution of finishing works (CPV 45400000).

6. The contracting authority provides for an optional (recommended but optional, e.g. at the request of contractors) on-site inspection and verification of documents necessary for the performance of the contract. Before submitting tenders, the contracting authority provides for the organization of a local inspection in the building in which the construction works will be carried out and access to the construction and executive design, which has the "RESTRICTED" clause after prior arrangement of the date – for contractors invited to submit tenders. Detailed requirements for on-site inspection and access to documents will be specified in the SWZ.
