1. The subject of the contract is successive deliveries of crushed aggregate as part of the investment task entitled: "Ongoing maintenance of forest roads in the Krośnice, Gogołowice and Rakłowice forest ranges".
2. The subject of the contract includes the purchase and successive delivery to the place of embedding (location of the investment task) of the following materials:
a) Crushed aggregate with a continuous grain size of 0/63 mm in the amount of 15164 tonnes
3. The moisture content of the crushed aggregate indicated above at the time of delivery may not exceed 12%,
4. The aggregate indicated above must meet the requirements set out in the Technical Specification constituting Annex 2 to the SWZ,
5. The minimum quantity of daily deliveries is 400 tons. Deliveries will be made from Monday to Friday from 07:00 to 16:00. Deliveries will be made within 24 hours of the phone/e-mail notification by the Ordering Party's representative.
1. The subject of the contract includes the purchase and successive deliveries to the place of incorporation of the material:
a) Crushed aggregate with a continuous grain size of 0/63 mm in the amount of 15164 tonnes
2. In all places of the SWZ and annexes to the SWZ, where an exemplary trademark, patent, origin, source or specific process was used, or if the Contracting Authority has described the subject of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Article 101 paragraph 1 point 2 and paragraph 3 of the Public Procurement Law, and in each case, acting in accordance with Article 99(6) and Article 101(4) of the Public Procurement Law, the Contracting Authority shall allow solutions equivalent to those specified in the SWZ and in the annexes to the CMS, marking such indications or references with the words "or equivalent" or "or equivalent" (m.in. use of materials), provided that the parameters are not worse than those specified in the description of the subject of the contract. An equivalent solution is also admissible if the word "equivalent" or "equivalent" does not appear in the description of the subject of the contract.
3. Each batch of aggregate supplied shall have the required legal documents conditional on the admission of each batch of supplied aggregate for marketing, including in particular: approvals, declarations of conformity, national/European technical assessments certificates, certificate of quality, study protocols.
4. When delivering the procedure in question, the Ordering Party reserves the right that:
(a) The quantities of aggregates falling within the scope of the contract are estimated in point 3.1. (3) of SZ. The quantity of the procured aggregate during the execution of the object of the contract may be less than those shown in point 3.1. (3) of the SWZ, which may not be the basis for any claims made by the Contractor in relation to the Contracting Authority. The Contracting Authority may contract during the implementation of the Agreement a scope of work less than that indicated in the SWZ, but not less than 70% of the Subject Value of the Agreement determined in accordance with § 8 (1) of the model contract as annex 8 to the SWZ.
(b) The remaining amount of aggregate will be received depending on the actual needs of the Ordering Party.
c) Supplies will be accounted for on the basis of the unit prices presented in the Offer and the quantities actually delivered. Therefore, the remuneration of the contractor will change in proportion to the deliveries actually made.
5. Additional information of the Ordering Party regarding the subject of the contract:
a) The Contractor is responsible for the implementation of the subject of the contract in accordance with the Act of 7 July 1994 Construction Law (consolidated text: Journal of Laws of 2020, item 1333, as amended) and applicable Standards.
b) The Contractor bears full responsibility for familiarizing himself with due diligence with the actual subject of the contract and for obtaining reliable information regarding the conditions and obligations that may in any way affect the value of the offer or the execution of deliveries. The Contractor bears full responsibility for the consequences of the lack or erroneous recognition of the conditions for the performance of the contract and the condition of the place of performance of the subject of the contract.
c) The Contractor is obliged to read the tender documentation (SWZ with attachments) and clarify any doubts at the stage of the procurement procedure and preparation of the offer.
