1. The subject of this contract is the supply of electricity to the Municipality of Lubsko and its organizational units, in accordance with the provisions of the Act of 10 April 1997. Energy Law (i.e. Journal of Laws of 2022, item 1385, as amended) and in implementing acts issued on its basis.

Energy Law (i.e. Journal of Laws of 2022, item 1385, as amended) and in implementing acts issued on its basis. 2. The scope of the contract includes the supply of electricity to En. Electrical (PPE) listed in Annex 10 Description of the subject of the contract SWZ. The estimated volume of electricity is 749 MWh for 12 months. The total amount of PPE is 58 pcs. 3. The subject of the contract does not cover matters related to the distribution of electricity, connection, metering and quality of energy falling within the scope of a separate agreement for the provision of distribution services concluded by the Customer with the Distribution System Operator. 4. The Contractor is obliged to declare that it has a General Distribution Agreement with the DSO Distribution System Operator operating in the Lubsko Municipality. 5. The selected Contractor shall prepare, complete and send through the appropriate information exchange platform (belonging to the local DSO) notifications of electricity sales (and on behalf of the Ordering Party will report the need to conclude new contracts for the distribution of electricity) to all Electricity Consumption Points (Annex 6 to SWZ – Annex 1 to the contract) to the Distribution System Operator (Enea Operator Sp. z o.o.) For this purpose, the Contractor shall also prepare an appropriate power of attorney (within 5 days of notifying the Ordering Party of the selection of the Contractor's offer), which it will submit to the Ordering Party for signature. In the event of a negative verification of any Electricity Consumption Point, the Contractor shall immediately notify (7 days counted from the moment when the notification of the sales contract receives the "negative" status) of this to the Ordering Party together with the reason for the negative verification. After determining the reasons for the negative verification with the Contractor, the Contractor shall report the sales contract again to the Distribution System Operator. 6. The Ordering Party in Annex 5 to the SWZ has included important provisions of the contract, the content of which the Contractor will be obliged to include in the contract with the Ordering Party. 7. The Ordering Party shall have the right, during the term of the electricity sales contract, to change the tariff group and contractual power on the generally applicable principles indicated by the DSO and regulations, in particular the Energy Law.
