1. The subject of the contract is the supply of electricity to the Nowy Targ City Hall building, street lighting and units of the Nowy Targ City Municipality in the period from July 1, 2023 to June 30, 2024.2. Details of the supply of electricity and the manner in which it is carried out:
1/ the scope of the contract includes the supply of energy in the amount of approximately 4 203 712 kWh,
2/ the indicated consumption is estimated and indicative, which serves only to evaluate and then compare offers, and consequently does not constitute an obligation of the contracting authority to purchase electricity in the given amount, which may be increased or decreased during the term of the contract, and the settlement will take place on the basis of the actual consumption of electricity in the facilities, in accordance with the meter indications, Other information about the subject can be found in the Terms of Reference

1/ the scope of the contract includes the supply of energy in the amount of approximately 4 203 712 kWh,
2/ indicated consumption is estimated and indicative, which serves only the valuation and subsequent comparison of tenders, and consequently does not constitute the obligation of the contracting party to purchase electricity in the quantity given, which may be increased or decreased during the period of execution of the contract, and the settlement will take place on the basis of actual electricity consumption in the facilities, according to the indications of the meters,
3/ the estimated electricity consumption during the above-mentioned period, contractual capacity, tariffs for individual facilities and their characteristics are indicated in the summary which is Annex 2 and 3 to this SWZ,
4/ quantity of electricity intake points, contractual capacity ordered may change, changes will be made in the form of an annex to the contract,
5/ increase of collection points or change of tariff group is possible only within tariff groups which are included in the SWZ and valued in the contractor's offer form,
6/ the contracting entity has currently concluded contracts for the sale of electricity in accordance with Annex 2 and 3 to this SWZ,
7/ electricity supplied by the contractor must comply with the requirements set out in applicable regulations, in particular the Energy Law Act (i.e. Journal of Laws 2021 item 716 as amended). and implementing acts issued on the basis of it, as well as other related thereto acts of applicable law and Polish standards,
8/ at the end of the procedure, the contracting authority shall transmit to the contractor whose offer is selected, any data necessary for the contractor to carry out the change of the seller,
9/ the contracting authority shall give the contractor an appropriate power of attorney to notify on behalf of the contracting authority of the contract for the sale of electricity to the DSO and to carry out the operations necessary to carry out the process of changing the seller with the DSO,
10/ the payment period for the execution of the subject of the contract shall not be less than 14 days from the date of delivery of the invoice correctly issued, not more than once a month, indicating the collection point and the amount of electricity consumption and delivery to the correspondence address of the recipient (indicated in the contract),
11/ the deadline for delivery to the recipient of a properly issued invoice or VAT invoices shall be fixed not less than 14 days before the payment date specified on the invoice. In the event of non-compliance with this deadline, the payment period indicated in the VAT invoice will automatically be extended by the time of delay,
12/ settlements will take place on the basis of actual electricity consumption (the use of planned instalments, forecasts invoices, estimate invoices) in the given settlement period according to the unit price resulting from the contractor's offer,
13/ the net unit price of electricity sales is consistent with the submitted offer,
14/ the gross unit price may change only in the event of a statutory change in the rate of value added tax, excise duty or a change in generally applicable law, in particular an amendment to the Energy Law, the Energy Efficiency Act or executive regulations introducing additional obligations related to the purchase of property rights or certificates regarding energy efficiency. Electricity prices are increased by the amount resulting from the obligations imposed by the relevant regulations, from the date of their entry into force, without the need to prepare an annex to the contract, Other information can be found in the SWZ.
