The subject of the contract is the performance by the Contractor for the benefit of the Contracting Authority (including design, delivery, assembly, commissioning, configuration and commissioning) of the investment entitled: Construction of a Heat Accumulator with a network water pumping station and accompanying infrastructure at the Żerań CHP Plant in Warsaw".
1. The subject of the contract is the performance by the Contractor for the benefit of the Contracting Authority (including design, delivery, assembly, commissioning, configuration and commissioning) of the investment entitled: Construction of a Heat Accumulator with a network water pumping station and accompanying infrastructure at the Żerań CHP Plant in Warsaw".
2. The scope of the contract includes, m.in, design, delivery, assembly, commissioning, configuration and commissioning of the heat accumulator installation, its cooperation with the existing technological and power system of the Żerań CHP Plant, as well as with the CDC control system and the Econtrol system in terms of the technological and power systems, respectively.
3. The subject of the contract shall be executed by the Contractor according to the "turnkey" formula in accordance with:
- Draft provisions of the agreement 23DOZZ263 together with annexes to the Agreement, in particular with Appendix No. 1 to the Agreement - Functional and Utility Program. Description of the Subject of the Contract – Technical Requirements (hereinafter also referred to as the "PFU"),
- documentation developed by the Contractor and agreed with the Contracting Authority.
4. The "turnkey" formula means comprehensive performance by the Contractor of all works in all industries in order to implement the Subject of the Contract and ensure its functioning in accordance with the terms and conditions of the Agreement, including, m.in, the performance of such works as: development of complete technical documentation (including, m.in, inventory, measurements and tests, construction design, detailed and as-built designs and other documentation in all trades), carrying out appropriate arrangements, official proceedings and performing all activities for the purpose of obtaining appropriate opinions, decisions, official and formal permits, preparation of the site and construction facilities, fencing of the construction site, complete disassembly and assembly as well as execution of temporary and other installations, delivery of all materials, apparatus, fittings and equipment necessary to perform the work, execution of necessary spacers and demolitions, execution of all works transport, execution of complete construction, assembly, installation, facility and programming works, utilization of waste generated as a result of carrying out works, regulation and commissioning of facilities included in the UAC, organization and participation of m.in. in the test run of the UAC and its commissioning, execution of all necessary accompanying and finishing works, both those included and not included in the tender materials and the submitted offer, provision of services resulting from warranty obligations and performance of all other necessary works to ensure the completeness of the performance of the subject matter of the Agreement, in accordance with its "turnkey" formula.
The "turnkey" formula also includes obtaining by the Contractor as part of the gross lump sum remuneration for the performance of the Contract all administrative decisions, arrangements, opinions, etc. necessary for the construction, commissioning and commissioning of the UAC (including the payment of fees related to obtaining such decisions).
