The subject of the contract is the management of municipal waste from the owners of real estate located in the Municipality of Zator in a municipal installation for waste processing through: sorting, composting and storage of municipal waste in the period from January 1, 2023 to December 31, 2023. Waste management is to be carried out in a way that ensures the achievement of appropriate levels of recycling, preparation for re-use and recovery by other methods and reducing the weight of biodegradable municipal waste transferred to landfill, in accordance with the provisions of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (consolidated text: Journal of Laws of 2021, item 888, as amended) and the provisions of the Waste Management Plan for the Małopolska Region. The amount of waste forecast is a total of about – 4 410 Mg.
The subject of the contract shall include in particular the performance of services in the field of:
1) Mechanical-biological processing of mixed municipal waste and discharge from mixed municipal waste fractions suitable in whole or in part for recovery,
2) treatment of selectively collected biodegradable waste with code 20 02 01 and kitchen waste with code 20 01 08, in accordance with the Act of 14 December 2012 on waste (i.e.: of 2022, item 699),
3) treatment of waste from separate collection and its purification and ensuring that the required levels of recovery and recycling specified by law are achieved,
4) conducting a mechanical-biological process of processing mixed municipal waste (sub-sieve fraction 0-80 mm),
5) storage of waste generated in the process of mechanical-biological treatment of unsegregated (mixed) municipal waste, residues from municipal waste sorting and ensuring that the required levels of storage specified by law are achieved,
6) dismantling of bulky waste,
7) treatment of repair waste.
The amount of waste forecast is a total of about – 4 410 Mg.
The Contractor undertakes to accept the actual amount of waste, varying downwards or upwards from the forecast.

The Contractor will ensure the management of all municipal waste covered by the scope of the contract from the municipality, generated during the contract execution period, i.e. from 01.01.2023. until 31.12.2023
The contracting authority provides for the award of contracts on the basis of Article 214(1)(7) of the PPL Act (up to 10%)
Subcontracting.
The Contracting Authority shall request that the Contractor indicate the part of the contract to which the performance intends to entrust the subcontractors This indication will be made in the offer form.
The absence of such information will mean that the entire contract will be carried out by the Contractor.
Employment under an employment contract.
The Contracting Authority, in accordance with Article 95 of the Pzp Act, requires employment by the Contractor or subcontractor under an employment contract within the meaning of the Labor Code of persons performing the following activities in the course of the execution of the contract:
•the employment requirement under a contract of employment applies to persons performing manual work related to the reception, weighing, sorting and composting of waste).
During the performance of the contract, the contracting authority is entitled to perform control activities towards the contractor regarding the fulfillment by the contractor or subcontractor of the requirement to employ persons performing the activities indicated in point 1 on the basis of an employment contract. The Ordering Party is entitled in particular to:
— requests for declarations and documents to confirm compliance with the requirements and evaluate them,
— request clarification in case of doubts regarding confirmation of compliance with the requirements, carrying out on-the-spot checks of performance.
