The subject of the Agreement includes the performance of the following activities at the Vehicles:
(1) maintenance levels P2 and P3 and seasonal inspections (PS) of Type 32EC EN77 series and Type 40WEa EN64 series vehicles, excluding washing, launching and de-fencing;
2) current and emergency repairs of EN77 series 32WE vehicles
3) providing warranty service for each Vehicle type 32WE EN77 series
4) maintaining a round-the-clock information point (service telephone line) at a telephone number operated by a Polish operator in Polish, in a tariff without increased call fees.
1. The Contractor shall be obliged to provide technical maintenance services for EMUs of P2 and P3 levels.
2. The scope of the contract does not include maintenance and control activities performed as part of the duties by train drivers and the operation of EMUs.
3. The expected average daily course of one EMUs is about 500 km.
4. The Contractor is obliged to perform all activities falling within the scope of implementation of maintenance levels P2 and P3, inclusive, in accordance with the current Maintenance System Documentation (DSU) referred to in the Regulation and the activities indicated in the Technical Documentation of the EMUs and the devices, assemblies and subassemblies installed therein.
5. The Contractor shall be obliged to plan and perform technical maintenance services of the EMUs in such a way that it is possible to operate the Contracting Authority on a daily basis, in accordance with the applicable timetable.
6. The contractor shall ensure professional performance of the subject of the contract by qualified, trained personnel with the necessary authorizations and certificates.
7. The subject of the contract shall be performed by the Contractor without undue delay, maintaining
for this purpose, the necessary number of personnel, regardless of the technical and organizational circumstances of the performance of the subject of the contract, in particular regardless of whether maintenance services will be performed on vehicles at the same time on the basis of other contracts concluded by the Contractor.
8. The Contractor shall bear all personnel costs necessary to perform the subject of the contract
9. The Contractor shall keep documentation (e.g. in the form of a book) individually for each Vehicle, in which all inspection and repair activities are recorded, to which the Ordering Party has the right to inspect at any time during the term of the Agreement. After the completion of the provision of the subject of the contract, the subject and complete documentation will be transferred to the Ordering Party without undue delay.
10. As part of the remuneration for the subject of the contract, the Contractor will ensure readiness to provide mobile service services, consisting in performing emergency repairs that do not take the vehicle out of operation and can be performed outside the technical facilities.
11. All works being the subject of the contract shall be performed by the Contractor in accordance with the current:
11.1. Technical documentation of the Vehicle and the devices installed in it:
11.1.1. Maintenance System Documentation (DSU) for 32WE EN77 series
11.1.2. Maintenance System Documentation (DSU) for 40WEa EN64 series
11.1.3. Technical and Operational Documentation of devices, assemblies and subassemblies installed in vehicles
11.2. documentation in place regarding safety-critical components in relation to the types of Vehicles
11.3. UIC standards and fiches referred to in the Technical Documentation
11.4. the provisions of the Safety Management System (SMS) and other implemented systems relating to the safe performance of maintenance works in force at the Ordering Party
11.5. relevant Polish Standards, Industry Standards in force during the term of the Agreement
11.6. internal regulations of the Ordering Party
11.7. regulations of the Infrastructure Manager
11.8. Occupational safety regulations
11.9. generally applicable laws.
12. The Contractor, when performing the works being the subject of the contract, will use only brand new spare parts and consumables. They should be consistent with the catalog of spare parts, DSU and DTR of a given Vehicle, assemblies, subassemblies and parts.
13. As part of the full warranty for the Vehicle type 32WE EN77 series, the Contractor undertakes to provide warranty service to the Ordering Party. The extension of the full warranty for the Vehicle covers the entire EMUs with all its assemblies and subassemblies also if the guarantee granted to the Contractor by manufacturers or sub-suppliers of assemblies or subassemblies is shorter than the guarantee granted to the Ordering Party for the EMU.
