a) The subject of the contract is the modernization of rooms for the needs of the new apparatus in accordance with Annex 3 along with the delivery to the place indicated by the Ordering Party at its headquarters, a completely new factory angiograph in a compatible configuration shown in Annex 4 constituting an integral part of the SWZ.
b) The equipment offered in the tender procedure must comply with the description of the subject of the contract and must meet the conditions for admission to trading in health care facilities in accordance with applicable law.
c) Failure to meet any of the required parameters shall give grounds to the Contracting Authority to reject the offer.
d) Partial deliveries of individual pieces of equipment shall not be permitted. The supplied equipment must be complete, marked, have the necessary instructions, guarantees, in appropriate packaging ensuring proper quality protection of the supplied equipment against weather conditions, damage, etc.
(e) Required minimum techn parameters

e) The required minimum technical parameters of the subject of the contract are specified in Annex 4 to this specification. If the offered equipment does not meet the minimum required parameters, the offer will be rejected without further evaluation.
f) If the specification would indicate trademarks or origin for certain equipment, the Contracting Authority, pursuant to Art. 99(5) of the Public Procurement Law, allows "equivalent products" to be offered. All "equivalent products" from specific manufacturers specify the minimum quality parameters and functional characteristics that the goods must meet in order to meet the requirements set by the Ordering Party and constitute only a quality standard of the subject of the contract. By the provision concerning the minimum requirements of quality parameters, the Ordering Party understands the requirements of goods contained in publicly available sources, catalogs, manufacturers' websites. Using exemplary names of the manufacturer is only aimed at clarifying the level of expectations of the Ordering Party in relation to a specific solution. In the case of offering "equivalent products", the Ordering Party requires the submission of relevant documents authenticating this equipment. These documents will be subject to the assessment of the Contracting Authority and will be the basis for the Ordering Party's decision to accept the "equivalents" or reject the offer due to their "non-equivalence".
g) The contracting authority does not allow the submission of variant bids.
h) The tender may relate to all or selected tasks. No partial bids may be submitted.
i) Each Contractor has the right to submit only one bid. The submission by one Contractor of more than one offer or offer containing alternatives results in the rejection of all offers submitted by a given Contractor.
j) The Ordering Party reserves the right to cancel the proceedings at any stage in the event of failure to receive the grant funds.
k) The warranty period may not be less than 36 months.
l) The delivery deadline is by 30 November 2023, however, the Ordering Party reserves that the angiography and hemodynamics laboratory may be closed for one month, i.e. from 01.11.2023. to 30.11.2023r.
m) The payment deadline is 60 days from a correctly issued invoice
n) Offers will be evaluated according to the criteria given in Chapter XV SWZ.
o) The draft provisions of the contract constitute Annex No. 1 to the SWZ, which is an integral part of this documentation and the provisions contained therein are treated as conditions for awarding the contract.
Due to the specific nature of the subject of the contract, the Contracting Authority, pursuant to Art. 131(2)(1) of the Public Procurement Law. requires the submission of tenders after an on-site inspection. Bearing in mind the above, before the deadline for submitting tenders for this procedure, the on-site inspection will be organized by the Contracting Authority. The contracting authority considers the on-site inspection to be necessary for the correct and comprehensive preparation of the offer. The Contractor shall bear all costs related to the preparation and submission of the tender. The contracting authority sets the date of the on-site inspection for 18.07.
