1. The subject of the order is the gradual delivery of Ekodiesel diesel oil to the headquarters of the Employer in Zakopane at ul. Szymony 17a in accordance with the current needs of the Employer. The Employer informs that the fuel (diesel oil) subject to this tender will be used by the Employer only for own purposes for refueling company cars. The Employer informs that the fuel (diesel oil) subject to this proceeding will not be resold.
2. The estimated estimated supply quantity of Ekodiesel diesel oil in the period from the day of signing the contract for a period of 12 months is 500,000 liters (option 300,000 liters).
A detailed description of the subject of the contract is included in the Specification of the Essential Terms of the Order (hereinafter: the Terms of Reference) available on the Employer's website.

The Employer informs that the fuel (diesel oil) subject to this tender will be used by the Employer only for own purposes for refueling company cars. The Employer informs that the fuel (diesel oil) subject to this proceeding will not be resold.
2. The estimated estimated supply quantity of Ekodiesel diesel oil in the period from the day of signing the contract for a period of 12 months is 500,000 liters (option 300,000 liters).
3. In accordance with the reservation in the option law, the Ordering Party will reliably purchase diesel fuel in the "guaranteed" quantity.
4. Other quantities described as "options" will be implemented depending on the actual needs of the Employer, in accordance with the following provision regarding the exercise of the option right. First of all, the Employer wishes to clarify that, in accordance with the provisions of the PPL Act, the option law institution assumes that the Employer always determines the minimum order level (500,000 liters) which will be certainly implemented by the Employer during the contract period, which allows Contractors to make reliable and proper performance offer valuation. In addition, the Employer indicates at the same time an additional range (300,000 liters), the implementation of which depends on the circumstances indicated in the contract and is the entitlement of the contracting authority, which he may or may not use. In this tender procedure in point 4.2 SIWZ The Employer specified the minimum estimated estimated amount of Ekodiesel diesel oil delivery in the period from the day of signing the contract for a period of 12 months which is 500,000 liters, in addition, the SIWZ further, the Employer indicated that it envisages exercising the option right in the amount of 300,000 liters (total quantity liters is 800,000, which, pursuant to Article 34 (5) of the PPL Act, was the basis for estimating the value of the contract). The Employer in the Terms of Reference informed the Contractors that the amount of 500,000 liters is a guaranteed quantity, and the option right is 300,000 liters, with the fact that the Employer provided for the supply of two types of Ekodiesel diesel oils, i.e.
1) Ekodiesel diesel oil with improved low-temperature properties - in the amount of 200,000 liters, with the proviso that this is the total amount covered by the option law,
2) Ekodiesel diesel oil in the amount of 600,000 liters, subject to a guaranteed quantity of 500,000 liters and a quantity of 100,000 liters covered by the law.
In addition, the Employer in point 4.7.1. The Terms of Reference stipulated that when placing the order he would indicate the type of fuel ordered. This means that the Ordering Party, by placing an order, will specify the type of fuel and the quantity of ordered fuel, which will be about 5,000 liters. Fuel delivery will only relate to one type of fuel specified by the Purchaser in the order.
5. The quality of Ekodiesel diesel fuel delivered should meet the requirements of legal regulations, including Ordinance of the Minister of Economy of October 9, 2015 on quality requirements for liquid fuels (Annex 3 to the Ordinance) or on the day of delivering a given batch of Ekodiesel diesel oil.
6. The Contractor is responsible for the quality of the delivered subject of the contract and for presenting with each delivery of diesel oil the current quality certificate (certificate), certified by the fuel producer for compliance with the Polish Standard or the accredited laboratory certificate (in Polish). The certificate will be associated with the delivery or issue document by placing the number and date of the certificate or attestation on it.
