6.1.5. The Contracting Authority shall request the submission with the offer of the evidence given in paragraph 6.1.1, 6.1.3 to confirm the conformity of the supply offered with the requirements set out in the description of the subject of the contract.

The Contracting Authority shall accept the equivalent measures of evidence in question if they confirm that the deliveries offered meet the requirements laid down by the Contracting Authority.

If the contractor does not submit the measures of evidence in question or the measures of evidence in question are incomplete, the contracting officer shall call for their submission or supplement within the time limit set. The Contracting Authority shall inform that, despite the provision of the summons, he shall not call for the submission or supplement of the evidence in question if the measure in question serves to confirm compliance with the characteristics or criteria set out in the description of the criteria for evaluation of tenders or if, despite submission the tender in question is subject to rejection or there are indications of annulment of the proceedings pursuant to Article 107 (3) of the Law Pzp.

The Contracting Authority may request explanations from the contractors regarding the content of the evidence in question.

6.2. In the event of joint application by the contractors, the single document shall be submitted by each of the contractors jointly applying for the contract. These documents confirm the fulfilment of the conditions of participation in the proceedings and the lack of grounds for exclusion to the extent in which each contractor demonstrates compliance with the conditions of participation in the proceedings and the absence of grounds for exclusion.

6.3. Subcontractors

6.3.1. The Contractor in accordance with Article 462 (1) of the Law of Public Procurement Act may entrust the execution of part of the contract to the The Contracting Authority shall request that the Contractor indicate the parts of the contract, the execution of which he intends to entrust to the subcontractor and indicate the names of subcontractors by the Contractor, if they are already known (shall be indicated in the Single European Procurement Document as Annex 3 to the SWZ).

6.4. Before selecting the most favourable tender, the Contractor shall call upon the contractor whose offer has been the highest rated to submit within the specified time limit, not less than 10 days, current at the date of submission of the following statements or documents:

6.4.1 List of statements or documents made by the contractor in the proceedings at the request of the contracting authority to confirm the absence of grounds for exclusion:

(a) current at the date of submission of the declaration in the form of a single European procurement document drawn up in accordance with the model standard form set out in Commission Implementing Regulation (EU) 2016/7 of 5 January 2016. EU No L 3, 6.1.2016, p. 16/, Annex No 3 to SWZ/

NOTE: Part IV ONE: The qualification criteria of the contractor are completed only by Part α.

(b) the allowance or information from the National Court Register or from the Central Records and Business Activities Information drawn up not earlier than 3 months prior to its filing, if separate provisions require entry in the register or records, in order to confirm the absence of grounds for exclusion pursuant to Article 109 (1) (4) of the Pzp Act;

(c) if the Contractor is established or domiciled outside the territory of the Republic of Poland, instead of the documents referred to in:

1) b — files a document or documents issued in the country where the contractor is established or domiciled, confirming that no liquidation has been opened or declared bankrupt.

2) The documents referred to in point 1) should be issued no earlier than 3 months prior to its submission.

3. If, in the country where the contractor is established or domiciled, the documents referred to in point 1 are not issued, they shall be replaced, respectively, in whole or in part, by a document containing the statement of the contractor accordingly, indicating the person or persons entitled to his or her representation, or declaration of the person to whom the document was intended to concern, taken under oath, or, if in the country where the contractor is established or domiciled, there are no provisions of a declaration under oath, made before a judicial or administrative authority, a notary, a body of self-government professional or economic, competent by virtue of the seat or place of residence of the contractor.

(d) In the case of joint application by the contractors for the award of a contract, the contracting authority shall examine whether there is no basis for exclusion against each of those contractors, the documents in point (a) (b) shall be submitted by each of the contractors jointly.

(e) Where the Contractor relies on the capacities or situations of the entities making the resources available, the Contractor shall provide, together with the statement referred to in point 6.4.1.a) of this SWZ, a statement of the resource sharing entity confirming the absence of grounds for exclusion of this the entity and accordingly fulfilling the conditions for participation in the proceedings to the extent that the contractor relies on its resources.

(f) The provisions of point (c) shall apply accordingly to entities providing resources located or domiciled outside the territory of the Republic of Poland.

6.4.2. List of statements or documents submitted by the contractor in the proceedings at the request of the contracting authority to confirm the conditions of participation in the proceedings:

(a) authorisation for the marketing of medicinal products in accordance with the Act of 6 September 2001 Pharmaceutical law /i.e. OJ 2021 item 974 of the In the case of medicinal products manufactured directly by the Contractor, the authorisation for the manufacture of medicinal products issued by the Chief Pharmaceutical Inspector shall apply to Part No 1, item 1-8,26-27 and Part No 3.

(b) a list of deliveries made during the last 3 years, and if the operating period is shorter, during that period, including their value, item, dates of performance and entities to whom supplies have been made and the attachment of evidence determining whether these supplies have been made duly done, with the evidence in question being references or other documents drawn up by the operator to whom the supply was made, and if the contractor for reasons independent of him is unable to obtain these documents - the statement of the contractor, constituting Annexes No 10,11,12 to SWZ in accordance with the part offered.

Where the contractor relies on experience in delivering deliveries carried out jointly with other contractors, the list referred to in this paragraph relates to the supplies in which the contractor directly participated and in the case of recurring or continuous benefits in which performing directly participated or participating.

6.5. Rules for participation in the proceedings of contractors jointly applying for the award of a contract.

6.5.1. Contractors jointly applying for the award of the contract are required to appoint a representative to represent them in the procedure or to represent them in the procedure and conclusion of the public procurement contract. A written power of attorney should be attached to the offer.

6.5.2. Contractors jointly applying for the contract shall be jointly and severally liable for the performance of the contract.

6.5.3. The Employer reserves the right to request Contractors submitting a joint bid to submit to the Employer a contract specifying their mutual relations before concluding the contract.

6.5.4. Contractors jointly applying for the award of the contract shall also mean contractors who are partners in a civil law partnership.
