The subject of the order “Receipt and development of municipal waste from property owners residing in the Community of Czechowice-Dziedzice” is the service of the collection and development of municipal waste arising on the property in the municipality of Czechowice-Dziedzice, on which they inhabit residents.
A detailed description of the object of the order shall include the annexes to the SWZ, i.e.:
- specification of service — Annex 10 to SWZ;
- the proposed provisions of the contract — Annex 11 to the SWZ
Which are an integral part of the specification of the order terms.

Requirements for hiring by a contractor or subcontractor of persons under the employment relationship of Article 95 of the Pzp Act.
The Contracting Authority requires employment by the Contractor or subcontractor on the basis of an employment contract within the meaning of the provisions of the Act of 26 June 1974 – Labour Code (consolidated text: Journal of Laws of 2023, item 1465) include the following types of activities:
- operation of specialized vehicles intended for waste collection,
- operation of the point of selective collection of municipal waste.
The method of verification of the employment of persons referred to in Chapter II, paragraph 5, point 5.1.SWZ and the authority of the Contracting Authority to control compliance with the requirements relating to the employment of persons referred to in paragraph 5.1.above and the sanctions for failure to comply with these requirements have been described in the proposed contractual provisions annexed to the SWZ.
The Contracting Authority shall not specify additional requirements relating to the employment of persons referred to in Article 96 (2) (2) of the Law Pzp.
The ecological aspect.
The contracting authority provided for the ecological nature of the contract in the tender evaluation criteria. The criterion entitled "Environmental aspect" will be considered on the basis of the number of vehicles meeting the "Euro V" emission standard or higher, provided by the Contractor in the offer form. Criterion entitled "Environmental education" – the Contractor's commitment to implement extended environmental education in the field of organizing an ecological picnic for residents at the event entitled "Days of Czechowice-Dziedzice" organized in the Municipality of Czechowice-Dziedzice and ensuring the collection of waste from the cleaning action of the Czechowice-Dziedzice Commune by residents will be evaluated.
As part of the subject of the contract, the Contracting Authority provides for the application of the option referred to in Article 441 of the PPL.
The scope of options includes 30% of the maximum remuneration of the Contractor referred to in paragraph 4.
Conditions for exercising the right of option:
a) the use of an optional order (option right) will depend on the needs of the Ordering Party.
b) the period within which the Ordering Party has the right to exercise the option right - during the term of the contract.
c) the Contracting Authority shall inform the Contractor about the intention to exercise the option right to a specific extent with a separate statement - an order. The lack of an appropriate order indicates the resignation from the optional order in whole or in part (if the Ordering Party has partially used optional orders).
d) The Ordering Party may use an optional order in whole or in part and is entitled to order several services as part of optional orders, the size of which will depend on the needs of the Ordering Party.
e) The Contractor is obliged to perform the contract provided for by the option law on the terms described in the SWZ and the provisions of the contract
Orders executed under the option are a unilateral right of the Ordering Party. Failure to place orders covered by the option does not give rise to any claims on the part of the Contractor against the Ordering Party.
Pursuant to Article 99(5) of the PPL, the subject of the contract may be described by indicating trademarks, patents or origin, source or specific process that characterizes products or services provided by a specific Contractor, if the Contracting Authority cannot describe the subject of the contract in a sufficiently precise and understandable manner, and such indication is accompanied by the words "or equivalent
