The subject of the contract is a comprehensive supply of electricity including the sale of electricity and the provision of its distribution services for the needs of street lighting in the Municipality of Tuszyn, and municipal facilities in 2023. The list and characteristics of the facilities covered by this contract are set out in Annex 1 to the SWZ. The Contracting Authority acts on its own behalf and on the basis of signed Agreements (Agreements for inspection at the headquarters of the Contracting Entity), on behalf of organizational units indicated in Annex 1 to the SWZ:
- Water supply and sewerage plant in Tuszyn,
- Municipal Sports and Recreation Centre in Tuszyn
1. The subject of the contract is a comprehensive supply of electricity including the sale of electricity and the provision of its distribution services for the needs of street lighting in the Municipality of Tuszyn and municipal facilities in 2023. The list and characteristics of the facilities covered by this contract are set out in Annex 1 to the SWZ.
2. The estimated electricity consumption for individual tariff groups during the contract execution period in the Ordering Party's facilities amounts to approx. 2 874 407 kWh – Annex 1 to the SWZ. The forecasted electricity consumption is indicative and does not constitute an obligation on the part of the Ordering Party to purchase energy in the given amount. The Contractor shall not be entitled to any claim for failure to collect the estimated amount of energy by the Ordering Party.
3. The supply of electricity for a new intake point not listed in Annex 1 to the SWZ or for the point where the power gain occurs due to a change in the use of installations and equipment at individual points shall be made on the basis of amendment of Annex No 1 to SWZ — Annex 1 to the Agreement, according to the rules set out in the contract. These amendments are possible only within those tariff groups included in the SWZ and the valuation in the Contractor's offer.
4. The subject of the contract should be performed on the basis of a comprehensive agreement referred to in Article 5(3) and (4) of the Act of 10 April 1997. Energy Law (Journal of Laws of 2022, item 1385, as amended). The order should be carried out in accordance with the provisions of the Energy Law and executive regulations issued to this Act, in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (Journal of Laws of 2007, No. 93, item 623, as amended) and other legal acts in this field.
5. The supplied energy must meet quality standards m.in in terms of quality parameters of electricity, quality of customer service and conditions for the provision of electricity transmission and distribution services, network traffic, network operation and use of the power system and interconnections, these standards have been included in particular in the Regulation of the Minister of Climate and Environment of 29 November 2022 on the method of shaping and calculating tariffs and the method of settlements in electricity trading (Journal of Laws of 2022, item 2505) and in the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (Journal of Laws of 2007 No. 93, item 623, as amended).
