As part of the administration's strategy to save costs and increase resource efficiency, in 2019, an action plan was outlined that provided for the risk management of the company Parques de Sintra - Monte da Lua, SA the choice, through prior consultation , from an insurance broker. The first objective was to carry out a risk management report with an emphasis on analyzing all operations and activities that could be mitigated and even avoided using insurance. Therefore, following the report, the need to establish an insurance portfolio with the “acquisition of insurance policies”, which is part of risk management and perfectly suited to the company and its status as a public company in the Business Sector of the State.
Warranties:
a) Those provided for in the General Accident at Work Regime, which are currently contained in Law number 98/2009, of 4 September;
b) All workers, whether permanent or casual, covered by the policyholder, including the administrators, are covered by this insurance contract, whenever indicated in the list of people to be insured (vacation payroll).
For this purpose, the policyholder undertakes to send the insurer, by the 15th (fifteenth) day of each month, the list of salary earnings of its employees, in relation to the previous month;
c) The risks of travel and the exercise of professional activity to and in member states of the European Union are automatically covered, including professional training actions, for periods of up to 30 (thirty) days, without the need for prior communication and without any tariff increase. In the event of an accident occurring in a foreign territory, the expenses incurred there related to medical, medication or hospital assistance, as well as the charges related to transport or repatriation, are borne by the insurer.
This insurance policy is contracted in the form of mandatory insurance, taking into account the legal obligation to insure that is imposed on the policyholder, due to his registration as a tourist entertainment company.
The insurance guarantees the coverage and capital identified in these particular conditions, in the event of an accident suffered by the recipients of the services provided by the policyholder under the exercise of tourist entertainment activities identified in these particular conditions.
In addition, accidents occurring during the travel of insured persons are considered to be included in the scope of this policy, provided they are carried out in groups and in the vehicle of the policyholder or assigned or rented to the policyholder.
The insured amount for each mandatory coverage cannot be less than the minimum amount legally established for this insurance.
Safe people:
- This insurance policy is contracted without name, and the recipients of the services provided by the policyholder under the exercise of tourist entertainment activities identified in these particular conditions are considered insured persons.
Territorial scope:
- This insurance policy is valid for accidents in Portugal.
Insurance coverage and capital:
- In accordance with the provisions of the applicable legislation, this personal accident insurance covers the following risks and insurance capital, per insured person:
a) Death or permanent disability, payment of capital equal to the minimum amount provided for by law,
b) Treatment, transportation and repatriation expenses, up to the limit of the minimum capital provided for by law.
Object of insurance:
- This insurance policy is contracted in the form of mandatory insurance, taking into account the legal obligation to insure the insured's civil liability arising from the exercise of the activity due to his registration as a tourist entertainment company,
- The insured amount cannot be less than the minimum amount legally established for this insurance.
Tourist entertainment activities:
Under the present insurance policy, civil liability resulting from or correlated with the exercise of the following tourist activities is guaranteed:
- Tree climbing and other obstacle courses,
- Nature observation activity,
- orientation activities,
- Teambuilding activities,
- Hiking and other pedestrian activities,
- Other outdoor tourism activities,
- Bike and Segway tours and activities,
- Equestrian tours and activities, in animal-drawn couplings and the like.
Policy guarantees:
This insurance policy guarantees, up to the limit of the contracted insurance capital, the indemnities that may legally fall on the insured, for civil liability resulting from property and / or non-property damage resulting from bodily and / or material injuries caused to third parties, arising the activities performed by the insured, as a tourist entertainment company.
The policy is made up of general conditions, particular conditions and special conditions. The particular and special conditions will derogate wholly or partially from everything in relation to them established in the general conditions of the policy, with no exclusions or limiting clauses being applicable in addition to those expressly provided for in these particular and special conditions. In case of disagreement, the particular conditions, for all purposes, will prevail over the special conditions and these over the general conditions.
- For the purposes of this contract, the policyholders' workers are insured persons, as well as members of their household.
a) The children, stepchildren and guardians of the worker who are economically dependent on the worker are considered to belong to the household, under the terms of the Personal Income Tax Code, or while they are studying;
b) For the purposes of including newborns in the policy, the date of birth will be considered provided that the inclusion is communicated in writing to the insurer within a maximum period of 30 (thirty) days after the date of birth or on the date of receipt of the respective inclusion in the insurer's services, if the communication occurs after that period.
