Delivery 2 pcs. Hardware kits for GFFF

The subject of the contract is the delivery of two pieces of equipment sets for the GFFF module. Each set will ultimately consist of three packages, i.e.: one package of protective equipment from part A, one package of operational equipment from part B and one package of logistics equipment from part C. The subject of the contract must be brand new. The subject of the contract has been divided into parts. The Ordering Party allows submission of tenders for the following lots, i.e.: Part A – delivery of two (2) identical packages of protective equipment; Part B – Delivery of two (2) identical operating equipment packages. Part C – delivery of two (2) identical packages of logistics equipment.

Part A – Delivery of two (2) identical packages of protective equipment

Part A – delivery of two (2) identical packages of protective equipment. A detailed description and manner of execution of the order in part A is included in the OPZ, constituting Annex 3A to the SWZ. The contracting authority provides for the application of the so-called reverse procedure referred to in Article 139(1) of the Act of 11 September 2019. Public Procurement Law (Journal of Laws of 2022, item 1710, as amended), hereinafter referred to as the "Public Procurement Law" or "Public Procurement Law", i.e. the Contracting Authority will first examine and evaluate bids, and then make a subjective qualification of the Contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. Under Art. 257 of the Public Procurement Law, the contracting authority provides for the possibility of cancelling the procedure in question if the public funds that the contracting authority intended to allocate to finance all or part of the contract have not been awarded to it. The contracting authority does not provide for the award of contracts referred to in Art. 214(1)(8) of the Public Procurement Law. The tender, the application and the means of proof (if required) submitted electronically must be signed with a qualified electronic signature. In the process of submitting a bid, application, including the evidence in question on the platform, the qualified electronic signature is submitted by the contractor directly on the document, which is then sent to the system (recommended option). INFORMATION FOR CONTRACTORS JOINTLY APPLYING FOR A CONTRACT AWARD (CIVIL PARTNERSHIPS/ CONSORTIA)

1. Economic operators may jointly apply for the award of a contract. In such a case, the Contractors shall appoint a representative to represent them in the proceedings or to represent and conclude a public procurement contract. The power of attorney should be attached to the offer in electronic form (i.e. in electronic form with a qualified electronic signature or in the form of a digital representation of the document in paper form with a qualified electronic signature of the principal).

2. In the case of Contractors jointly applying for the award of a contract, the Espousel European Procurement Document and the statements of the contractor/contractor jointly applying for the award of the contract regarding the grounds for exclusion from Article 5k of Regulation 833/2014 and Article 7(1) of the Act on special arrangements for countering the promotion of aggression against Ukraine and for the protection of national security shall be submitted by each of the Contractors jointly applying for order. This statement initially confirms the fulfilment of the conditions for participation in the proceedings and the absence of grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the proceedings.

3. Statements and documents confirming the absence of grounds for exclusion from the proceedings, including a statement concerning belonging or not belonging to the same group, shall be submitted by each of the Contractors jointly applying for the contract.

4. Contractors jointly applying for the award of the contract indicate in the tender form which supplies the individual Contractors will perform.

5. Contractors performing jointly and severally shall be jointly and severally liable for the obligations arising from the concluded contract.

Subcontracting

1. The Contractor may entrust the execution of part of the contract to the subcontractor (subcontractors).

2. The Awarding Entity does not reserve the obligation for the Contractor to perform key parts of the contract personally.

3. The Contracting Authority requires that in the event of entrusting part of the contract to subcontractors, the Contractor shall indicate in the offer parts of the contract, the execution of which he intends to entrust to subcontractors and provide (if they are known to him at this stage) the names (companies) of those subcontractors.

4. Entrusting part of the contract to subcontractors does not relieve the Contractor from liability for proper performance of the contract.
