1. The subject of the public contract is a service consisting in the collection and management of municipal waste from residential and uninhabited real estate located in the Łochów commune.
2. Detailed scope and description of the subject of the contract, including the scope and description referred to in art. 6f of the Act of 13.9.1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2018, item 1454, as amended) is contained in the Detailed description of the subject of the contract, hereinafter referred to as "SOPZ", which is Annex 1 to the ToR.
1. The subject of the public contract is a service consisting in the collection and management of municipal waste from residential and uninhabited real estate located in the Łochów commune.
2. The scope of the contract includes:
1) collecting and managing the municipal waste from residential and uninhabited real estate indicated in the detailed description of the subject of the order, located in the Łochów commune;
2) collecting and managing municipal waste delivered to the Selective Municipal Waste Collection Point (PSZOK) established in the Łochów commune (PSZOK is located in Łojewo on plots registration no. 682, 684, 687);
3) achieving appropriate levels of recycling, preparation for reuse and recovery of other municipal waste fractions by other methods in accordance with the Regulation of the Minister of the Environment of 14.12.2016 on recycling levels, preparation for reuse and recovery of certain municipal waste fractions by other methods (Journal of U. of 2016, item 2167);
4) limiting the mass of biodegradable municipal waste sent for storage to the levels indicated in the Regulation of the Minister of the Environment of 15.12.2017 on the levels of limiting the storage of mass of biodegradable municipal waste (Journal of Laws of 2017, item 2412).
3. Detailed scope and description of the subject of the contract, including the scope and description referred to in art. 6f of the Act of 13.9.1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2018, item 1454, as amended) is contained in the Detailed description of the subject of the contract, hereinafter referred to as "SOPZ", which is Annex 1 to the ToR.
4. The Contractor is obliged to perform the subject of the contract in accordance with the ToR and the documents attached thereto, the offer and applicable provisions of generally applicable and local law in the current version as at the date of the contract, maintaining the highest professional level.
5. The Employer does not reserve the obligation for the Contractor to perform key parts of the contract personally.
6. Employment clause based on an employment contract pursuant to art. 29 paragraph 3a of the PPL Act:
1) The Employer requires employment by the Contractor or Subcontractor under a contract of employment of persons performing the following activities in the field of the contract: performance of works covered by the subject of the contract, including works related to the operation of vehicles adapted to receive mixed and selectively collected waste, if the implementation of these activities on performing work within the meaning of the Labor Code;
2) determining the working time and the number of people is the responsibility of the Contractor;
3) the detailed obligations of the Contractor in the field of employment under the employment contract are regulated in the model contract.
