1. The subject of the contract includes delivery with implementation of a language platform in the form of an access license at the State Higher School of Eastern Europe in Przemyśl adapted to the needs of people with disabilities along with a service and warranty service as part of the project entitled "Accessible University – PWSW"
2.The contract has not been divided into lots and therefore partial tenders may not be submitted.
3.Reasons for not dividing into parts:
The scope of work of the task in question is one technically related whole and should be carried out by a single contractor.
The subject of the contract is a complete, integrated IT tool, and the need to coordinate different Contractors could threaten the proper implementation of the task.

The subject of the contract includes delivery and implementation of a language platform in the form of an access license at the State Higher School of Eastern Europe in Przemyśl adapted to the needs of people with disabilities together with a service and warranty service as part of the project entitled "Accessible University – PWSW" No. POWR.03.05.00-00-A028/20 implemented under the Operational Programme Knowledge Education Development, Priority III Higher education for economy and development, Measure 3.5 Comprehensive programmes of higher education institutions, co-financed by the European Union under the European Social Fund.
2. The contract has not been divided into lots and the submission of partial tenders shall therefore not be permitted.

4. The subject and scope of the contract is described in Annex 1 to swz – Detailed description of the subject of the contract.
5. The Ordering Party requires that the offered subject of the contract meets the quality and technical standards resulting from the function and purpose, is free from physical and legal defects, is not encumbered with any rights for third parties.
6. Checking the subject of the contract will consist in making sure that the subject of delivery is free from physical defects, works as intended, and in particular corresponds to the description of the subject of the contract contained in the selected offer.
7. The requirements for warranty (service support) have been specified in detail in the draft provisions of the contract - Annex 5 to the SWZ.
9. Pursuant to Article 101(5) of the PPL Act, where the description of the subject of the contract refers to standards, the service offered does not have to comply with the required standards, but the contractor is obliged to prove in the tender that the proposed solutions meet the requirements set out in the description of the subject of the contract to an equivalent extent.
10. When the description of the subject of the contract has been constructed by specifying the requirements for efficiency or functionality, then, in accordance with Article 101(6) of the PPL Act, the contractor may invoke the compliance of the services offered with the relevant standards, if they concern performance or functionality requirements specified by the contracting authority.
11. The use of equivalent solutions shall be indicated in the tender, regardless of whether the contracting authority requests the economic operator to submit the means of proof in question.
