The object of the contract is the conclusion of a framework agreement, the purpose of which is to determine the terms of the contracts (in particular the prices of the subject of the contract) that may be awarded during the term of the framework agreement, hereinafter referred to as procurement. On the basis of the framework agreement, the Contracting Authority provides for the possibility of placing orders for the supply of fifty brand new five-car or comparable electric multiple units (EMUs), the same type and model, the provision of EMUs maintenance services, inspections in maintenance levels P1, P2, P3 within 18 years from the delivery of a given EMU, or until a given EMU, reaches a mileage of 2 592 000 km, whichever comes first, conducting training of the Ordering Party's employees in the field of EMUs service, delivery of repair and crash packages for EMUs and the possibility of using the option to perform up to two repairs in the P4 maintenance level of each delivered EMU.

The object of the contract is the conclusion of a framework agreement the purpose of which is to determine the terms of the contracts (in particular the prices of the subject of the contract) which may be awarded during the term of the framework agreement, hereinafter referred to as contracts. On the basis of a framework agreement, the Contracting Authority provides for the possibility of placing orders for:
1) delivery of fourteen brand new five-car or comparable EMUs – tranche I, of the same type and model, provision of EMUs maintenance services inspections in maintenance levels P1, P2, P3 within 18 years from the delivery of a given EMU, or until a given EMU, reaches a mileage of 2 592 000 km, whichever occurs first, training of the Ordering Party's employees in the use of EMUs and with the possibility of using the option to perform a maximum of two horizontal repairs maintaining P4 of each EMUs supplied,
2) delivery of fourteen brand new five-car or comparable EMUs – tranche II, of the same type and model and the same as EMUs referred to in point 1, provision of EMUs maintenance services inspections in maintenance levels P1, P2, P3 within 18 years from the delivery of a given EMU, or until the EMUs reach a mileage of 2 592 000 km, depending on what comes first, training of the Ordering Party's employees in the use of EMUs and with the possibility of using the option to perform a maximum of two repairs in the P4 maintenance level of each delivered EMU,
3) delivery of eleven brand new five-unit or comparable EMUs – tranche III, of the same type and model and the same as EMUs referred to in point 1, provision of EMUs maintenance services inspections in maintenance levels P1, P2, P3 within 18 years from the delivery of a given EMU, or until the EMUs reach a mileage of 2 592 000 km, depending on what comes first, training of the Ordering Party's employees in the use of EMUs and with the possibility of using the option to perform a maximum of two repairs in the P4 maintenance level of each delivered EMU,
4) delivery of eleven brand new five-car or comparable EMUs – tranche IV, of the same type and model and the same as EMUs referred to in point 1, provision of EMUs maintenance services inspections in maintenance levels P1, P2, P3 within 18 years from the delivery of a given EMU, or until the EMUs reach a mileage of 2 592 000 km, depending on what comes first, training of the Ordering Party's employees in the use of EMUs and with the possibility of using the option to perform a maximum of two repairs in the P4 maintenance level of each delivered EMU,
5) delivery of a repair-collision package for the EMUs – tranche I,
6) delivery of a repair-collision package for EMUs – tranche II.
Comparable EMUs should be understood as EMUs that have a different number of elements than five, but meet all the technical parameters indicated in the Technical Requirements for Electric Multiple Units constituting Annexes No. 2 and No. 2.1 to the Draft provisions of the framework agreement.
2. In all provisions of the SWZ and its annexes, which refer to standards, technical assessments, technical specifications and technical reference systems, in accordance with Article 101(4) of the PPL, the Contracting Authority allows the use of solutions equivalent to the solutions described in the standards, technical assessments, technical specifications and technical reference systems indicated in the SWZ and annexes if they allow to obtain features or parameters not worse than those referred to in the SWZ and Annexes.
If equivalent solutions are applied, the Contractor shall prove in the tender, in particular by means of the evidence referred to in Articles 104-107 of the PPL, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent degree.
3. A detailed description, scope, requirements and manner of implementation of the subject of the contract is specified in the Specification of the Terms of Contract.
