The subject of the contract entitled "Trees for Wola" in Warsaw is the planting of 150 pcs. trees with trunk circumferences min. 30 cm. (measurement at a height of 100 cm. from the ground).
1) The subject of the contract awarded is the planting of 150 pcs. trees with trunk circumferences of at least 30 cm (measurement at a height of 100 cm from the ground) as part of the task from the civic budget entitled "Trees in Wola".
2) A detailed description of the subject of the contract, the scope, manner and requirements for the performance of the service being the subject of the contract shall specify:
a) draft provisions of the contract – a model contract, hereinafter also referred to as a model contract,
b) description of the subject of the contract constituting an integral part of the contract – Appendix No. 1 to the model contract.
The above documents constitute Appendix No. 6 to the SWZ.
3) The Contracting Authority in the proceedings in question applies the social clause pursuant to Article 95 of the PPL Act. The Contracting Authority requires that persons performing the subject of the contract and performing activities related to gardening works and development of green areas, be employed by the Contractor or Subcontractor, on the basis of an employment relationship, in accordance with the Act of 26 June 1974. Labour Code (i.e. Journal of Laws of 2020, item 1320, as amended). Detailed requirements regarding the method of documenting and verifying the employment of these persons and the Ordering Party's right to control this employment and sanctions for failure to meet these requirements are contained in the model contract, constituting Annex 6 to the SWZ.
4) information about the division/failure to split the order into parts.
The contracting authority divided the contract related to the maintenance of green areas in the Wola District into parts, each of which is the subject of a separate procedure. The present proceedings concern one of the abovementioned parts of the contract.
5) The Ordering Party informs that it intends to allocate a gross amount of PLN 650,000.00 to finance the awarded contract.
6) Warranty and guarantee:
The contractor will provide a guarantee for the executed object of the contract for a minimum period of 12 months.
The Contractor may propose to extend the warranty period for the subject of the contract to 24 months.
The warranty period for the subject of the contract is a criterion for the evaluation of tenders – see Chapter XIV of the SWZ.
(7) The contracting authority does not provide for the possibility of awarding contracts pursuant to Article 214(1)(7) of the PPL.
8) Subcontractors: The Contracting Authority does not make a reservation regarding the obligation to personally perform key parts of the contract by the Contractor.
9) Subcontractors: all information regarding subcontracting, the Ordering Party has included in the model contract, constituting Appendix No. 6 to the SWZ. The Contracting Authority requires that the Contractor in the statement - Single European Procurement Document (JEDZ) indicate to the Ordering Party whether it will perform the contract on its own or whether it intends to entrust subcontractors with the performance of part of the contract.
10) The order must be completed within 3 months from the date of conclusion of the contract.
