Taking blood samples and determining the capacity for detention

The Bonn Police Headquarters uses licensed doctors to carry out its tasks. Framework contracts are to be concluded which determine the contractual conditions independently of a specific later request in order to cover the resulting need for the above medical services quickly and without time-consuming individual award procedures.

On-call service Taking blood samples late and at night (3:00 p.m. to 7:00 a.m.), weekend and public holidays (7:00 a.m. to 7:00 a.m. of the following day) properties on the left bank of the Rhine

The subject of this invitation to tender is the award of framework contracts for the provision of medical services, such as taking blood samples and medical examinations to determine the person's ability to detain.

The framework agreements should run from June 1st, 2021 to May 31st, 2025. The contracts are expected to be put out to tender again on June 1st, 2025 for a period of four years.

The subject of the order or service to be provided for the client is divided into the following areas:

Blood draws

As part of a standby plan (see section 4 of this service description), the client must take blood samples to determine the influence of alcohol, medication and drugs in the event of criminal offenses and administrative offenses at the client's respective properties (see section 3 of this service description).

The blood is drawn according to the rules of medical art through a vein puncture, usually from a vein in the upper extremities. For this purpose, the client provides the contractor with complete blood collection systems (differentiated according to alcohol or narcotics) as well as the necessary consumables. The contractor must use the valves in accordance with the manufacturer's instructions for use. The contractor is responsible for the safe disposal of the consumables and the cannula needles. For this purpose, appropriately marked puncture-proof containers are provided by the client.

In individual cases in which the accused / the person concerned refers to the so-called "post-drink", the client will order a second blood sample 30 minutes after the first blood sample. In this case, the contractor must remain on site. The remuneration of the residence fee is granted in accordance with the provisions of the GOÄ (see section 9 of the service description).

The contractor must ensure that mix-ups are ruled out when taking blood. For this purpose, the client provides four-part adhesive labels with an identity number printed on them. The stickers must be labeled accordingly. One sticker is to be stuck on the tube filled with blood, the other three stickers are to be given to the police officer on duty. The contractor must certify the correctness of the labeling by signing the adhesive label.

Finally, the medical report to be drawn up in connection with the blood collection (medical report form, see Annex 6) must be carefully drawn up by the contractor immediately on site, as the findings made in criminal / administrative offense proceedings are of legal significance.

Investigations to determine the capacity for detention

According to the police custody order (see Annex 9) for the state of North Rhine-Westphalia, a person may only be admitted to police custody if they are capable of custody. Therefore, within the framework of a standby plan (see section 4 of this service description), at the request of the client, the contractor has to conduct investigations to determine the ability to detain in the police custody rooms of the Bonn police headquarters and the inner city police station (in exceptional cases also in those mentioned in section 3 of this service description Real estate).

The determination of the ability to detain includes the examinations required from a medical point of view to assess the psycho-physical condition, a history-taking (possibly with the help of an interpreter) as well as the examination of the person concerned for the existence of at least the following points, which could prevent him from being placed in police custody:

- Obviously not insignificant external injuries,

- Existing influence of alcohol, medication and drugs,

- Existing withdrawal symptoms such as states of confusion and hallucinations due to alcohol, medication and drug consumption,

- statements about pain,

- Determination of an existing need for medication.

These are primarily expert activities. Continuous medical or medical supervision by the contractor is not intended.

The client provides the contractor with the following equipment in order to carry out the test of detention capacity:

- breath test device,

- First aid kit including ventilation mask,

- personal protective equipment in accordance with the industrial safety regulations (e.g. disposable gloves) and

- Urine screening drug pre-tests (e.g. opiates, methadone, benzodiazepines, cocaine, amphetamine).

The contractor must provide the following minimum tools:

- stethoscope,

- reflex hammer,

- diagnostic lamp,

- thermometer,

- sphygmomanometer and

- blood glucose meter.
