The subject of the contract is the construction of five damming dams in the form of a dam and watercourses on the "inflow from under Proszysk" watercourse to improve and stabilize the humidity conditions of forest habitats in the Młyny Forest District in the Miradz Forest District. The undertaking will be implemented in the commune of Strzelno, Mir Mir District, plot of land no. 3085, 3105, 3106, 3130, 3131, 3153. A detailed description of the subject of the contract is included in the construction design, detailed design, detailed technical specification and bill of quantities which are attachments to the ToR.

The subject of the contract is the construction of five damming dams in the form of a dam and watercourses on the "inflow from under Proszysk" watercourse to improve and stabilize the humidity conditions of forest habitats in the Młyny Forest District in the Miradz Forest District. The undertaking will be implemented in the commune of Strzelno, Mir Mir District, plot of land no. 3085, 3105, 3106, 3130, 3131, 3153.

Additional conditions regarding the subject of the contract:

a) all works must be carried out in accordance with applicable regulations, in particular with the requirements of the Act of 7.7.1994 Construction Law (consolidated text Journal of Laws of 2018, item 1202), standards, technical conditions and building art , provisions on health and safety at work during construction works specified in the Regulation of the Minister of Infrastructure of 6.2.2003 on occupational health and safety during construction works. (Journal of Laws of 2003, No. 47, item 401), with fire protection regulations and in accordance with the design documentation, STWIORB, as well as with the instructions of the supervision inspector,

b) during the execution of works, the construction site must be marked,

c) The Contractor is required to have a policy or other insurance document confirming that the Contractor is insured against civil liability in the scope of conducted activity throughout the term of the contract, for an amount of min. PLN 100,000

d) The Employer requires the Contractor to grant a warranty for a minimum period of 5 years from the date of final acceptance of the works.

e) The Awarding Entity may pursue claims under the warranty for defects also after the expiry of the warranty period, if he reports a defect before the expiry of that period,

f) If in any place in the design documentation, Technical Specification of Performance and Acceptance of Works, the manufacturer's names, proper names, trademarks, patents or origin of materials or devices used to perform this order have been indicated - the Ordering Party shall add the words "or equivalent" everywhere

g) Materials and devices that are equivalent in terms of technical, quality, functional and functional parameters may be used for materials and devices indicated in the project documentation, for which the manufacturer's names, proper names, trademarks, patents or origin are indicated. The devices and materials provided for use should meet the parameters specified in the project documentation and should not be worse than the design assumptions,

h) According to art. 30 paragraph 5 of the Public Procurement Law, the contractor who refers to equivalent solutions described by the contracting authority is required to demonstrate that the construction works offered by him meet the requirements specified by the contracting authority.
