The subject of the contract is the selection of an advertising agency to handle the bank's promotional and advertising activities for the years 2024-2026 supporting the Ordering Party in the implementation of the online and offline advertising strategy addressed to specific groups of stakeholders and the provision of comprehensive ATL, BTL and Digital services.
1. The subject of the contract is the selection of an advertising agency to handle the bank's promotional and advertising activities for the years 2024-2026 supporting the Contracting Authority in the implementation of the online and offline advertising strategy addressed to specific groups of stakeholders and the provision of comprehensive ATL, BTL and Digital services.
The subject of the contract will be carried out depending on the needs of the Contracting Authority and includes the following tasks:
1) cooperation in the creation of BGK's offline and online advertising strategy,
2) Providing comprehensive services:
a) ATL (advertising addressed to a wide target group, e.g. TV or outdoor advertising);
b) BTL (advertising addressed to an individualized customer, mainly serves conversion purposes);
c) Digital (online marketing); in accordance with Appendix No. 1 - Description of the Subject of the Contract to the Agreement;
3) other activities listed in the OPZ, closely related to the performance of the Agreement and indicated therein.
2. A detailed description of the subject matter of the contract, terms and conditions of contract performance and payment is set out in the Description of the Subject of the Contract (hereinafter: "GTC") and the Draft provisions of the agreement (hereinafter: "PPU").
3. The contracting authority divided the subject of the contract into a basic contract and a contract covered by the option right.
The subject of the basic contract is the provision by the Contractor to the Contracting Authority of the services specified in the OPZ for the duration of the Agreement or until the amount referred to in §7 section 1 point 1) of the Agreement is exhausted, whichever occurs first.
The subject of the contract covered by the law is the provision by the Contractor to the Contracting Authority of the services specified in the OPZ after the funds allocated for the performance of the basic contract have been used up until the end of the term of the Agreement or until the amount referred to in §7 section 1 point 2) of the Agreement is exhausted, whichever occurs first.
After spending 50% of the remuneration provided for in the Basic Contract, as indicated in § 7 section 1 point 1) of the Agreement, the Contracting Authority shall conduct an assessment of cooperation with the Contractor, and the assessment will have an impact on the Contracting Authority's decision to exercise the Option. The detailed assessment process is set out in Appendix 2 to the Terms of Reference-PPU.
The Contracting Authority shall inform that the right of option is an entitlement of the Contracting Authority, which it may, but does not have to exercise under this contract. The exercise of the right of option, in whole or in part, is reserved to the sole decision of the Ordering Party. If the Contractor does not exercise the right of the option in all or part of the Contractor, there will be no additional remuneration or any claim.
