1. The subject of the contract is the supply of electricity in the period from 1.1.2019 to 31.12.2019 to 1638 consumption points (PPE) with a total estimated volume of 21.318.40 MWh, of which:
Zone I 14,707.88 MWh
Zone II 6,372.92 MWh
Zone III 237.60 MWh
The forecast electricity consumption indicated above is indicative and may differ from the amount of energy actually consumed during the contract period. Reducing or increasing the amount of energy consumed does not entail any consequences for the contracting parties (recipients), except for the need to pay for the energy actually consumed at the rates specified in the Contract.
1. Quality standards: The subject of the contract is the supply of electricity with specified quality standards in accordance with applicable regulations - Regulation of the Minister of Economy and Labor of 20.12.2004 on detailed conditions for connecting entities to power networks, network operation and operation, specifying among others technical parameters of electricity.
The quality standards of electricity are described in the Act of 10.4.1997 - Energy Law and in the Regulation of the Minister of Economy of 4.5.2007 on detailed conditions for the functioning of the power system. The principles of shaping and calculating tariffs and settlements in electricity trading are set out in the Regulation of the Minister of Energy of 29.12.2017.
2. Settlement periods used:
C1x, G - 2 (two) months,
C2x, B - 1 (one) month
3. Measuring systems with the tariff group B are adapted to the procedure of changing the seller.
4. Distribution services will be provided on the basis of separate contracts concluded between the awarding entities (electricity consumers - hereinafter "consumers") and the distribution system operator (DSO).
5. Distribution system operator - as described in Annex 1 to the ToR, column "Distribution System Operator".
6. The Contractor, based on the Power of Attorney granted, will be obliged to submit electricity sales contracts to the appropriate DSO in accordance with applicable regulations on behalf of the contracting authority (customers).
7. The condition for starting the supply of electricity by the indicated date (in relation to individual consumption points) is the positive conduct of the supplier change procedure, the customer's possession of a valid contract for the provision of electricity distribution services and effective termination / expiry of existing contracts for the sale of electricity / contracts complex:
1) In the case of valid comprehensive contracts or indefinite contracts for the sale of electricity, the contracting authorities (customers) shall submit (in relation to individual consumption points) appropriate declarations regarding the termination of contracts with effect on the day preceding the planned date of commencement of deliveries (in Annex No. 1 to the ToR, column " Delivery period "), and copies of the notice will be forwarded to the contractor whose offer will be considered the most advantageous.
2) In the case of having timely sales contracts, their validity expires on the day preceding the planned delivery start date (in Annex 1 to the ToR, column "Delivery period").
8. In Annex 1, the column "Change of seller" indicates in relation to which PPE the change of seller will occur for the first time, and in relation to which once again.
9. The Awarding Entity informs that pursuant to Article 24aa of the Public Procurement Law, it provides for the possibility to first evaluate the offers and then to check whether the contractor whose offer has been assessed as the most advantageous is not subject to exclusion and whether the contractor meets the conditions for participation in the procedure. If the contractor referred to in the first sentence fails to conclude the contract, the contracting authority will examine whether the contractor who submitted the highest-rated offer among the remaining offers is not excluded and whether he meets the conditions for participation in the procedure.
