The subject of this contract is "Collection and management of municipal waste from real estate located in Sector I of the Association of Municipalities of the Płock Region - within the scope of the Bielsk Commune".
A detailed description of the Object of the Order is specified in Section II to the ToR.
Employer in accordance with art. 29 paragraph 3a of the Act "Pzp" requires employment by the Contractor or subcontractor, on the basis of an employment contract, of persons performing the activities of the contract indicated by the Employer, if the performance of these activities involves the performance of work in the manner specified in art. 22 §1 of the Act of 26.6.1974 - Labor Code (i.e. Journal of Laws of 2018, item 917, as amended). The scope of work of persons performing the activities indicated by the Employer in the implementation of this contract and the method of documenting the employment of these people and the Employer's rights in controlling the Contractor's compliance with the requirements and sanctions for non-compliance are set out in §12 of the model Agreement.
The subject of the contract is "Collection and management of municipal waste
from real estate located in Sector I of the Association of Municipalities of the Płock Region - within the scope of the Bielsk Commune. " The scope of the subject of the contract, including the obligations of the Contractor are described in detail in the ToR in Section II to the ToR (OPZ) and the draft contract, which is an attachment to the ToR. The applicable form of the Contractor's remuneration is a lump sum remuneration for the entire duration of the contract from 1.7.2019 to 31.12.2019 - determined as a result of the selection of the Contractor's offer submitted in the tender procedure. The contract's settlement period is one calendar month. The contractor undertakes to perform the contract with the help of persons employed under a contract of employment in the following areas: collection, transport and transfer for further management of municipal waste - vehicle drivers and loaders performing the service. Supervision over the service and implementation of the contract signed as a result of the public procurement - contract coordinator. In the event of the expiration or termination of the employment relationship with the employee referred to above, the Contractor undertakes within 30 days from the termination of employment to employment under a contract of employment in his place another person who will continue to perform the contract. The Contractor shall submit to the Employer within 14 days from the date of signing the contract a statement of concluded employment contracts containing a list of employment contracts of all persons referred to in paragraph 1 above. The statement should include the type of employment contract, and in the case of fixed-term contracts - the duration of the contract period, the date of the employment contract, working time, position and information on what activities under the contract will be carried out by the employee, unless it results directly from the name of his job position. According to the previous sentence, the statement provided by the Contractor will prevent the identification of the employee's personal data in accordance with applicable law. In the event of any change in the employment status of an employee, the Contractor shall provide the Employer with relevant information within 30 days from the date of the change. The Employer has the right to control the Contractor's compliance with the obligation referred to in paragraph 1 above. Under the right of control, the Employer may, in particular, oblige the Contractor to submit documents constituting proof of employment and set an appropriate time limit for this purpose, not shorter than 7 days. The proof of employment is in particular anonymous (making it impossible to identify the employee's personal data in accordance with applicable law), copies of current employment contracts or the employee's social security application. The contracting authority does not provide for the possibility of awarding a supplementary contract. The Employer requires a deposit by the Contractor. Before signing the contract, the Employer requires the Contractor to provide due security for the contract.
