Description:
Transport of disabled children living in Warsaw in the Wola District along with providing them with care during transport in the school year 2023/2024 - procedure number: 25/ZP/23.

1) The subject of the contract is the transport of disabled children residing in Warsaw in the Wola District along with providing them with care during transport in the school year 2023/2024, i.e. from 01.09.2023 to 31.08.2024.

2) Transport will take place on the route from homes to schools/educational institutions located in the m.st. Warsaw and back, to schools/centers located outside the m.st of Warsaw in accordance with the calendar of the school year 2023/2024 and to institutions where classes are held as part of the "Winter/Summer in the City" campaign during winter holidays and holidays.

3) A detailed description of the subject of the contract, the conditions and manner of providing services constituting the subject of the contract shall specify:

a) model agreement, constituting Annex 6 to the SWZ together with Annex 2 entitled list of children and schools,

b) price form, which constitutes Annex 13 to SWZ.

1) Routes for the transport of children are listed in Annex 2 (List of Children and Schools) to the draft provisions of the agreement, hereinafter also referred to as the model agreement, which is Annex 6 to the SWZ. The list shows transport routes for 79 children. The contracting authority, as part of the performance of the contract, allows the possibility of increasing the number of transported children to a maximum of 90 children.

2) Caregivers must have preparation to perform basic nursing and care activities and completed a course or training in first aid, as well as at least 3 months of experience in caring for disabled people.

3) The Contractor should provide the services constituting the subject of the contract with cars appropriately adapted to the transport of disabled people, in accordance with the requirements of the Contracting Authority specified in Chapter VII SWZ.

4) In the event of temporary inability to provide transport services due to a road collision or vehicle breakdown, the Contractor is obliged to substitute a replacement vehicle of an equivalent standard within a maximum of 60 minutes from the occurrence of the event. The response time, i.e. the time in which the Contractor will substitute a replacement car at the scene of the incident, in the event of a vehicle breakdown or a road collision during the transport of children, is the second criterion for evaluating the offer, see Chapter XIV SWZ.

5) The year of manufacture of cars used by the Contractor for transport may not be earlier than 2015. The year of manufacture of the cars in which children will be transported is the third criterion for evaluating offers, see Chapter XIV SWZ.

6) The contracting authority in the proceedings in question applies the social clause pursuant to Article 95 of the PPL. The contracting authority requires that persons performing the subject of the contract and performing the activities of drivers and guardians be employed by the Contractor or Subcontractor, on the basis of an employment relationship, in accordance with the Act of 26 June 1974. Labour Code (i.e. Journal of Laws of 2022, item 1510, as amended). Detailed requirements regarding the method of documenting and verifying the employment of these persons and the rights of the Contracting Authority in the scope of control of this employment and sanctions for failure to meet these requirements are included in the model contract, constituting Annex 6 to the SWZ.

7) Information on the division/non-division of the contract into lots - justification, see Chapter II point 4 SWZ.

8) Pursuant to § 7 clause 2 of the model contract, the Contractor is obliged to have a civil liability policy for the conducted activity for the sum insured not lower than PLN 400,000.00 (in words: four hundred thousand zlotys 00/100), throughout the duration of the contract.

9) The Contracting Authority informs that it intends to allocate a gross amount of PLN 1,846,626.12 to finance the awarded contract.

11) The contracting authority does not provide for the possibility of awarding contracts pursuant to Article 214(1)(7) of the PPL.

12) Subcontractors: all information regarding subcontracting, the Contracting Authority included in the model contract, constituting Annex 6 to the SWZ. The Contracting Authority requires that the Contractor in the statement - the Single European Procurement Document (ESPD) indicates to the Contracting Authority whether it will perform the contract on its own or whether it intends to entrust the Subcontractors with the performance of part of the contract.

13) The Contracting Authority provides for the application of the procedure referred to in Article 139(1) of the PPL. Pursuant to the said provision, the Contracting Authority shall first examine and evaluate the bids, and then make the subjective qualification of the Contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
