The material scope of the contract includes:1) Winter maintenance of road surfaces, sidewalks (excluding sidewalks directly adjacent to the property), pedestrian crossings, parking lots, bays and bus stops, bicycle paths, green belts of national, provincial and district streets in the city of Chełm; 2) Winter maintenance of road surfaces, sidewalks (excluding sidewalks directly adjacent to the property), pedestrian crossings, parking lots, bays and bus stops, bicycle paths, green belts of municipal streets and internal roads in the city of Chełm; 3 Post-winter road cleaning referred to in § 2(7) of the contract; 4 Other cleaning operations referred to in Paragraph 2(8) of the contract. The proceedings are conducted in accordance with the rules provided for in the reverse procedure referred to in Article 139(1) of the Act. Criteria: price 60%, the amount of the contractual penalty in the removal of defects found on receipt 24%, the time of performance of the intervention service from the occurrence of the notification16%.

The subject of the contract is defined by: Draft Agreement Provisions (PPU) – Annex 8 to the SWZ. The Contractor may entrust the performance of part of the contract to Subcontractors.Contractors may jointly apply for the award of the contract. In such a case, the Contractors shall appoint a representative to represent them in the procurement procedure or to represent them in the procedure and conclude a public procurement contract. The power of attorney should be attached to the offer in electronic form. In the case of Contractors jointly applying for the award of a contract, the European Single Procurement Document (ESPD) shall be submitted by each of the Economic Operators jointly applying for the contract. This statement initially confirms the fulfilment of the conditions for participation in the proceedings and the absence of grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the proceedings and the absence of grounds for exclusion. The Contractor is obliged to submit together with the offer a statement constituting a preliminary confirmation that the Contractor as at the date of submission of tenders:a) is not subject to exclusion,b) meets the conditions for participation in the procedure The declaration referred to in point 6.1 of the SWZ The Contractor is obliged to submit in the form of a single document drawn up in accordance with the model standard form set out in the Implementing Regulation of the European Commission 2016/7 of 5 January 2016 issued on the basis of Article 59 paragraph 2 Directive 2014/24/EU, hereinafter referred to as the 'Single Document' or 'ESP'. – according to Annex 2 to the SWZ. Exclusion pursuant to Article 7(1) of the Act of 13 April 2022 on special solutions in the field of counteracting support for aggression against Ukraine and serving to protect national security (i.e. Journal of Laws of 2023, item 1497) takes place for the duration of the circumstances specified in point 4.6. SWZ.

The Contractor is also excluded on the basis of Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in connection with Russia's actions destabilising the situation in Ukraine (Dz.U. L 229, 31.7.2014) as amended by Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 2022/576). L 111 of 8.4.2022). In order to confirm the absence of grounds for exclusion from participation in the proceedings:1) information from the National Criminal Register in the scope of:a) Article 108(1)(1) and (2) of the PPL; b) Article 108(1)(4) of the PPL, concerning the imposition of a ban on applying for a public contract as a penal measure, drawn up not earlier than 6 months before its submission; 2) the Contractor's statement within the scope of Article 108(1)(5) of the PPL, on the lack of belonging to the same capital group, within the meaning of the Act of 16 February 2007 on competition and consumer protection (Journal of Laws of 2023, item 1689), with another Contractor who submitted a separate offer, or a statement on belonging to the same capital group together with documents or information confirming the preparation of the offer, independently of another Contractor belonging to the same capital group. Model - Annex 4 to the SWZ; 3) the Contractor's statement on the validity of the information contained in the statement referred to in Article 125(1) of the Act, to the extent relating to the grounds for exclusion indicated in Article 108(1)(3)-(6) of the Act and in the scope of the grounds for exclusion indicated in Article 109(1)(5.7) of the Act. In the proceedings in question, communication between the Contracting Authority and the Contractor, including the submission of tenders, exchange of information and the transfer of documents or statements, taking into account the exceptions provided for in the Act, takes place using electronic means of communication, via the Platform located at: https://umchelm.ezamawiajacy.pl in the "Correspondence" tab.
